The defense spent much of the day attacking how strongly the forensic evidence could actually be interpreted. FBI forensic examiner Amanda Bakker was questioned for roughly three hours as defense attorney Michael Burt dug into the technical details of the DNA testing, mixtures, statistical interpretation and the limitations of what the results could establish about when or how DNA was deposited on the objects. Robinson’s lawyers also pushed back against the State’s motive theory, challenging the attempt to characterize the killing as being driven by Kirk’s religious beliefs in addition to political disagreement. By the end of day two, prosecutors had added important physical evidence to the surveillance case presented on day one, but the defense had begun laying out the approach it would use throughout the hearing: concede that certain items contained Robinson-associated evidence while aggressively challenging what that evidence actually proved about possession, timing, motive and the circumstances of Kirk’s killing.

What's up everyone and welcome back to the program. In this episode we're going to get right back to the Tyler Robinson prelim hearing day number two. Question by Kathy Nester, okay, and then you've been talking a lot about a timeline here that seemed you talked about it when you were watching the video. But you also talked about the fact that you developed the timeline, is that right? Answer correct. Question, and can you pull up, hold one please? I'm pulling up on your screen your report that you prepared. Do you recognize that? Answer, I do, yes. Question, and what's the date that you drafted that report? Answer, it looks like September 14th it says, date created. Question, and that's the place where, if you could go to page two please, do you see down at the bottom where you summarize Sergeant Bricker's report, listing the timeline? Answer, yes. Question, okay. And so it was actually Sergeant Bricker that prepared the timeline, is that right? Answer, he prepared a timeline. Question, and you incorporated that into your report? Answer, no, I created a timeline. Question, you created your own timeline. Answer, yes.
Question, separate from the one that's in this report? Answer, yeah. Using information obtained in the investigation. Question, and when did you create the timeline? Answer over the course of the investigation, over a long period of time, after a lot of reviewing video and investigative time. Question, okay. So as of September 14th, Tyler Robinson had already turned himself into authorities, is that right? Answer, yeah. I believe he turned himself in on September 11th. Question, so prior to that time that Tyler Robinson turned himself in, had you all prepared a timeline? Answer a documented written timeline? A question? Yes. Answer, not to my knowledge. I don't know when Sergeant Bricker produced his specifically? Question, and is it fair? To say that, as of the moment, Tyler Robinson voluntarily surrendered to authorities in Washington County, as of the moment, you all did not know who the shooter was, is that right? Answer, we had identified a person of interest, but we did not specifically know who the shooter was at the time. Question, okay.
And you became aware that Mr. Robinson was voluntarily surrendering. How did you become aware of that? Answer, the information came originally, I believe, from the Washington County Sheriff to the administration, at the control center, at the university on the evening of the investigation, or the second evening of the investigation. Question, all right, we're going to go back to that in a minute, but I just wanted to get the timeline down, all right? Now I want to go back to the videos that we've seen and the question that I just asked before, which is, isn't fair, to say that nothing about the video of the individual on the roof revealed to you, you can see facial features, you can see what they were wearing, correct? Answer, of the individual on the roof? Question, correct, answer. I know that there was a meeting to discuss, perhaps a pattern on the front of the shirt that was observed when the individual was jumping off the roof. Question, okay, that's fair, but at the time, as of the 11th before Mr. Robinson turned himself in, you all had not been able to determine that, is that right? Answer, excuse me, determine who he was,
or determine distinguishing features? Question, determine distinguishing features of the video of the person on the roof? Answer, yeah, we had a person of interest and those images were released to the press. Question, you're talking about the ones in the stairwell? Answer, correct. Nester, from the parking garage? Answer, correct, question, but the video on the roof was not distinguishable fairer. Answer, the video as a standalone? Answer, yes. Question, it was not, no. Question, okay, and in fact, the video on the roof, well, strike that. Is it true that you had some spectators that you interviewed that had gotten a photograph a few seconds before the shooting of someone on the roof? Answer, sorry, I don't understand the question. Question, did you at some point near investigation collect from two young men who were present at the event a video that had been taken of someone on the roof about 10 seconds before the shooting? Answer, yes, a video, yes, not photographs. A video was collected from an individual who had a video.
Question, and ultimately some screenshots were taken out of that video, is that right? Answer, buy, question, buy you, answer, not by me, no. Question, okay, that's fine, it could have been someone else. Answer, okay, question, but did you see the video that those young men took? Answer, if you're referring to the video that's looking north and shows an individual dressed in dark clothing on the corner of the roof. Question, yes, answer, if that's the video, I have seen that video, yes. Question, did you review the interview of those young men? Answer, I did not. Question, do you know how they described the person on the roof? Answer, I don't know if I read it or if I heard it, but my understanding was they believed it was Overwatch or some kind of police Overwatch if that's my recollection. Question, okay, and do you remember anything specific about the person's build that they discussed when they described the person on the roof? Answer, I do not. Question, okay, there's a portion of the video after the individual jumped off the roof,
which we all saw here, where the individual crosses, I believe, its campus drive, is that right? Answer, that's correct. Question, and there's a moment where the individual waits, and there's two cars that pass in front of them, right in front of them. Answer, correct. Question, and is this the moment where you were submitting that he was holding a gun in his hand? Answer, as he crossed the road, question, yes, answer, I from my observations, which show that he's carrying an object in his hand, that's concealed, we're in a bag, and it's long, and has the appearance, based on my training and experience, it could be a firearm. Question, but do you see a gun anywhere, the actual gun? Question in the video? Question, yes, answer, no. Question, all right, and did anybody that was driving by on campus that day report to you or any other investigative div entity, hey, we just drove by a guy with a gun who was leaving campus, and he stand right by my car. Answer, we did not receive any reports to that effect, no. Question, okay, also, when you were revealing the timeline, exactly how long was
there between when the person was prone on the roof and when the shot was taken? Do you recall? Answer, if you would like to replay the video, I can time it for you, but I don't recall, it was my guess, my guess I would estimate, between 15 and 30 seconds. Question, so between 15 and 30 seconds, delay flat, take a shot, get up and run off, right? Answer, I think you asked how long you was prone. Question, right, answer, I think it took longer for him to crawl into position. Question, okay, answer, and then establish position and then take the shot. He appeared to be prone for approximately 15 to 30 seconds, but the video would verify that. Question, okay, thank you, all right, I want to talk to you for just a minute about the video that was taken, and I'm not going to get into, I'm going to show it, just show, in case anybody concerned about leaving the courtroom, I'm not going to show it, but there was a video that was taken by Mr. Ty Phillips, and that was the individual that was speaking to Mr. Kirk. Answer, correct, question, and it
showed that on view of Mr. Kirk and his parts of his security team is that right, and then you also have video that you described that shows the back of the tent at the moment that the shot happened. Is it that right behind Mr. Kirk? Answer, you're referring to the UVU video in the breezeway, answer yes, question, or question yes, answer, we have that video yes, question, okay, and can we pull up the last video, the last clip 49, I want to show you, just you, this clip, that is a little clip from the video under the breezeway, that's behind the tent, right? Answer correct, question, and just to be clear, this area behind the tent would not have been visible to anybody that was on the Losey building, is that fair? Answer, I can't answer that question, the judge jumps in, can I just interrupt for a moment? And Mr. Nester, as you're playing this, are you just being cognizant if the sound is on or not? Kathy Nester, I don't want the sound, please, judge, I just wanted to clarify, Nester, thank you for bringing that up, thank you.
Kathy Nester, no sound, I just want only the winners to look at it, so can you just watch this clip for just a minute, this one little clip of behind the breezeway at the time of the shot? Judge, that's fine, and also just a reminder to all the parties, it's on your monitor, please be cognizant of that, it will not be displayed on the main monitor, Ms. Nester, you may proceed. Question, thank you, is it playing? Okay, do you remember that? Does that refresh your memory of what's in that clip? Answer, yes, question, and having reviewed that at the time the shot was fired, there was no one standing directly behind the tent, is that correct? Answer, you'd have to show me again, I wasn't specifically looking for that. Question, okay, answer, but I can answer that question, if I can view the video again. Question, okay, and just before you do that, I think you testified that Mr. Kirk would have been dead center behind the banner, is that right? Answer, approximately. Question, okay, so what I'm asking is if anyone behind the banner, dead center behind Mr. Kirk, if there was any people standing there, go ahead. Answer, so there's a videographer
on the right side of the tent, and then I can only see as far as the video allows me to, so I can't speak to whether there's anybody out of frame who could have been behind the tent. Question, but what you can see, is there anyone directly behind the middle of the tent? Answer, yeah, there's a videographer who stood behind the tent. Question to the right? Answer, yes, behind the tent. Question, correct, but directly in the middle of the tent, is there anyone standing? Answer, there is no one stood in the middle behind the tent, no. Question, thank you, all right, I want to talk now about TP. You can take it down off the screen, thank you, I want to talk now about TP USA video, that you got, that was the angle that was taken from behind Mr. Kirk while he was talking, looking out at the audience when the shot was fired. Do you remember that video? Answer the video, the visual impulse videos? Answer, yes. Question, yes, answer, yes. Question, all right, is it true that visual impulse provided for videos? Answer, yeah, I believe there were total
four videos that encompassed everything that they provided to us, yes. Question, but then the one that you showed that's only one of the four videos they provided to you, answer, that that one was shown at had a base number. It was an item that was provided by the Utah County Attorney's Office. Question, okay, but there are more that you haven't seen in the courtroom in this prelim that you got from gets cut off by the agent. There's original footage, question, okay, but there were other angles that they have not shown here in this prelim answer, yes. Question, okay, that's what I was trying to get to. Thank you. All right, were you involved in the gun that was located in the forest? Answer, I was not involved in the search for the gun. No. Question, did you get notice when it was located? Answer, from the footage that we reviewed, we identified an area that we believed could potentially be an evidentiary value and then it was secured and then I was notified that as a result of that search, a gun had been located. Yes. Question, were you involved in processing the
gun? In other words, boxing it, shipping it, sending it, wherever it was going to be analyzed? Answer, I was not.
