The federal indictment names JP Miller. It does not name the people around him who allegedly helped. But that doesn't mean they're safe. Court filings describe church members and associates who allegedly executed physical tasks in the harassment of Mica Miller — the kind of acts that leave evidence law enforcement can trace.

Miller was indicted in December 2025 on charges of cyberstalking and making false statements to federal investigators. The alleged conduct ran from November 2022 until Mica's death in April 2024 and includes tracking devices on her vehicle, more than fifty contacts in a day, interference with her finances, tire damage, and an intimate image posted online. Miller has pleaded not guilty and denies the allegations. He has not been charged in Mica's death, which was ruled a suicide. She was thirty. She filed for divorce two days before she died. Trial is October 2026.

South Carolina has no coercive control law. That gap limits what the state can pursue against the alleged psychological torment. But the physical acts described in the filings — the tracking, the following, the damage — carry separate legal risk for anyone who allegedly carried them out. The insulation that allegedly protected Miller may not protect his helpers.

I think the best thing Netflix has done all year is release the Micah Millie documentary. I really do, because it shines such a spotlight

where it's needed to be shown. We're continuing to dig into the John Paul Miller Micah Millie case today. And there's a specific angle that's driving a lot of us kind of crazy. South Carolina doesn't have coercive control laws, which makes it incredibly difficult to hold JP fully accountable for the sheer psychological torment that Micah endured in the allegations against him. But JP doesn't operate in the vacuum. He had help. He allegedly used people in his inner circle to do some of his dirty work. So he wouldn't get caught on camera. Now his network is scattering and we have to ask, what happens to the enablers? Joining me to break this down is defense attorney and former prosecutor Eric Fattis and Robin Drake retired FBI special agent, chief of the counterintelligence behavior analysis program. Let's start with the help because they are scattering like flies. Now again, JP is saying I'm not guilty of any of these charges against me.

It's all bullshit. Blah blah blah. So that's where we're at on all of that. And a lot of the friends too, very much distancing themselves or former friends saying, we weren't that tight, that close all that. That's why we're here. The exposure of the help. So Eric, because South Carolina lacks that coercive control law, the state has a hard time hitting JP with much further psychological abuse. That's where the fed charges are coming in. But what about the people, the people who helped him? Considering the allegations, what kind of legal exposure, if any, considering JP doesn't seem to have much at all in the state of South Carolina, do the people who are now running like scared cockroaches that have just gotten singed as the building is collapsing? What kind of exposure do they actually have? Right now. If much of anything. Certainly. So, under the doctrine of accomplice liability, that's a legal theory by which folks who may have assisted or provided aid

could be roped in including in a critical context. Usually to prove that, you have to establish that the conspirator or the accomplice share the same mental state as the principal wrong actor here that would allegedly be John Paul Miller. So, that they knew what John Paul Miller was doing that they provided some material assistance in terms of that course of dealing, that course of alleged criminal activity over time. And if those things can be established then those folks could be in many states just as liable criminally as the principal actor themselves. But without significant criminal charges at the state level against John Paul Miller, that's gonna be difficult at least at this stage. But we're learning more. When we have, because right now there's the federal charges against John Paul Miller, there's no state charges there. And we know in federal charges, they tend to go after your bigger fish, if you will, not to waste their time.

And John Paul would be the bigger fish in this case. Does the federal authorities have any interest in going after the best friends or the buddies or the this or the that? If they played minor roles in his allegations of the control and such, like for example, the GPS trackers that they were continuously finding on Micah's car, that's part of this case. Did John Paul put them there? Did one of his minions put him there? I guess if one of the minions put the trackers there is that something that they would then go after the minion for following the orders of John Paul, or does that kind of get into the gray area of well, how did he ask you? Do we have a record of him in asking you? Is that provable? Because I could see where it gets into a gray area where there's gonna be plausible deniability on the part of John Paul saying, I never asked for that. And then the feds is going, fuck it. We don't care about that person. That's not the problem anyhow. The problem is JP.

You know, the feds have to prioritize what they're doing. And they've got to go up to the folks whom they think are important with respect to a given event. That being said, I mean, there's a national fervor around this case, everybody's talking about it. And so, you know, is there kind of an optics motivation, a peak motivation perhaps for the feds to do a complete and thorough investigation and potential prosecution of any alleged complices? I think that there is probably an appetite for that in the federal government just based on the momentum that this case has garnered in the public eye. And that'll be interesting, because when you bring that up, I just have flashbacks to my time in and what actually reached a bar for feds wanting to get involved because even though I work counterintelligence, when you work in a smaller office like I did at the end of my career, we have a lot of overlap with a lot of local, with a lot of local violations. And for us, it was a dollar amount. You know, if a certain thing didn't hit a certain dollar threshold, we weren't interested in it.

And even came down to like public corruption and white collar crimes. And even though you might have some righteous stuff, if it didn't hit that threshold to lead to something bigger like a JP, and it was a tough one to go after. But to Eric's point, it's what kind of hey do they want to make? So if this is in the public spotlight, if they can make some PR, hey, they might go down that track. It's a small office, a small resident agency, as Jennifer Kaufman ever said the other day. So to them to expend resources means it takes it's taking time away from other potential big cases. So that's part of it. So there's a lot of considerations that go into making the sausage, as we say, behind the decision process I'm going after it and on. It is, you know, JP obviously operates religious organization. He's shielded most of his assets behind them, at least from what we've seen. And operates with somewhat of a shield there. Let me ask you that.

Ask you both this. I mean, from an investigative standpoint and from a prosecutorial standpoint, how much more difficult is it to go after someone who is operating not just as a monster? You know, let's say if he was running a used car lot and doing this to people, you know, that's a commercial business. He's running a church. How much more difficult is it to dig into the infrastructure of that and the people within it versus a commercial entity to get to the bottom of what the hell's going on here and to expose and bring to justice and bring to light the people that need to have that happen to them considering the religious end of it. Eric? You know, one thing that's central to that question is the Fourth Amendment, which provides protections against unreasonable searches and seizures. So if law enforcement wanted information from the church, including, you know, emails, text messages,

internal documents, things like that, they would probably have to seek a search warrant and that implicates the First Amendment, or Fourth Amendment, excuse me. And in doing so, the Fifth Amendment is concerned with privacy and so, you know, religious organization have a higher expectation of privacy in their documents and their internal affairs than a private business. I don't know that they actually do, but they certainly could try to resist any investigative efforts on that ground by saying, hey, for example, the identity of the folks in our congregation, that's private. People are entitled to sort of practice their own religion with reasonable degree of privacy if they want that. And so could that present an impediment to this investigation? I think the church would hope that it would. So, and that's an interesting question. Do they stand outside the law? No, but here's again, on the practical side of things, and this is also field office dependent on, because there's 56 field offices of the FBI

across the country with a lot of resident agencies that are subbed under those. If we were going to conduct to grant it, you know, I wasn't criminal investigator for all my career counterintelligence, but we did dabble in this, that dealt with churches a lot in the world of counterintelligence, believe it or not, with being then being used by nefarious people as a cover, kind of like this is being used. And so getting authority to conduct interviews, investigations, and also to open up sources, human sources inside of church, inside of church organization, took a much higher level for us to get authority to do, not legally necessarily, but just that authority. So like we'd have a guy like Eric, so our view office has our Chief Division Council, the CDC. Our Chief Division Council had to sign off on absolutely anything we wanted to do that was considered a sensitive nature and that meant a public official, elected official, church personnel, it's all exactly the same thing. So it took a higher level of us being able to get authority as a street agent to be able to do these investigations,

which typically means if you have a street agent doesn't want to bother with that shit, you're going to, if you have a plate and you're plates this thick, this stacked high, and you have all these things you could be working on, all of them righteous, where you're going to focus your attention, the lower hang and fruit that I don't have to get all these approvals and authorities for, that people are going to second guess, and then, and here's what they're second guessing. They're second guessing their exposure a lot of times. And so if Robin goes out and conducts his interview, and it goes sideways, it hits the press in a negative way, and it has negative blowback on the FBI, the office or anything else, they're likelihood of you approving to do that interview. There's a lot lower, or what they'll do is, they'll send in an executive from the executive staff out with you to do that interview, just to kind of soften the blow, but how often, if you have, you know, you're trying to build trust and rapport with someone that's going to be a source for you inside this organization when you show up with one of your chief executives, listen to likelihood they're going to talk without a lawyer. Slim to none. Let me ask you this Eric. A lot of the people who were in the Netflix stock,

they were asked, have you talked with the FBI? Many of them have over the course of this. There's been several people though that were still very tight with John Paul after the filming of this completed after, even the release of the doc. We've seen some this week. And I'm not going to name names, but there's several that were close to him that have made statements to various outlets saying, basic bullshit. I wasn't that close. It was this. It's a lot of, let's put this over here and try and get as far as we can. What would you say to one of them? Let's just do this as a public service. What would you say? Should, should they come knocking on your door going, you know what? I don't know if I need an attorney or not, but I feel like I could be exposed here at some point in time. They may come looking at me. I'd rather not be responsible. I'd rather get ahead of this shit because I have, I have stuff to offer. I have information on your big fish over here.

Could you get me as a small fish? Sure, but I'd like to protect myself from that ever happening. What would you advise a friend who may be very close, who may know a lot about this? What would you advise them to do and how to handle delivering that information to set authorities for the purpose of prosecuting John Paul Miller and protecting your own ass from the stupid decisions you made while being under the mind control of Oal Wizard remaster, John Paul Miller. And in these investigations, it's not uncommon for folks like you described who have some significant information who might really kind of come out of the woodwork and say, hey, you know, before you get me, let me help you get this dude. And then you can arrange a request to arrange a proper whereby the idea is that you'd be given certain promises regarding immunity or other protections in exchange

for not only providing the information, but that requires Tony ongoing cooperation, typically with the prosecution up to and including giving sworn testimony at a future trial. So it's a big commitment, but it certainly would be a way to protect those folks. And you're not talking about like a gang situation where coming forward could risk your own life at least in that way. And so there's a lesser risk for becoming a cooperating government witness in this context. The JP Miller trial is coming up here very soon, like within a month for these, if it stays on track, how open do you think the prosecution is to new witnesses popping up and saying, hey, I got information here. Are they looking for this information right up to the day or are they massaging down the final details of their plan of how they're gonna attack this in court? I don't know how that works behind this scene. Give us some insight. You've got to kind of have your head on a swivel

and adapt as you're preparing a case for trial. So you've got what you think the case is going to be and the information you have. And then sometimes days before a game changer could be placed upon your desk and you've got to decide hey, do we try to make moves and hustle to get this incorporated into our current case? Does that mean we have to add charges? Does that mean there's gonna be a delay or a continuance of the trial? And would that serve the interests of justice or do you think you have a slam dunk that you don't want to muck up by adding additional people and stuff? And so it's a calculus you got to make. Every day is your approaching a trial as new information might arise. And you could also, I'm talking about how to keep people safe and feel safe to share information. They still have, they don't have a dedicated, I was just looking to sub-over-chat and they don't have a dedicated tip line for this case. But if people do have any information, because again, a lot of people down there do tune into our show, you can still call the FBI tip line,

which is 1-800-CALL-FBI. And the FBI on Columbia Field Office is 803-5514-200. You can do so anonymously. And yeah, we're still a ways out like Eric was saying. And so if they get a bombshell dropping on their desk, especially if it involves any sort of abuse or involvement with anyone else, especially if they're under certain ages and you have knowledge of that, I think that's a critical thing to know as well. Because I seriously doubt if this is, this kind of control or attempt to control in someone's life is a one-off for this individual. So I think more leakage and more information could always be helpful. Whether they move on it or not. Well, what surprised me initially about the charges against John Plummiller from the Feds is that it doesn't come with that much of a penalty. I mean, seven years seems to be max. Probably far less than that if it even gets there. It's like, seems like kind of a weak, not a weak case, but a weak penalty for what it is, but it is what it is.

And I was always wondering early on, is this just the tip of the iceberg? Is this just, we're gonna go in, we gotta start with something and get a charge going and get this ball rolling. So we're gonna start with this. Eric, in your opinion, when you're looking at how this investigation has played out so far, we have the trial, it's supposedly happening next month. How do you read it? Do you read this as, well, that's how it began, but we're probably not gonna get to trial for years from now because they're launching this, thinking there's going to be more charges. There's going to be more that we're going to find underneath these rocks here. Is that what's going on? Or is it, oh, you know, full steam ahead on these seven years potential for John Paul? I can't help but think that initially, the federal government talked to themselves, hey, there's some suspicious stuff going on and we have a dead person. And we worry that we suspect that this person could be a person of interest, John Paul Miller in that. We think we can get them on this lower stuff.

So let's hook them on that for now. And then continue our investigation and hope something else materialized with respect to this more serious alleged offense. It seems like they haven't got to that second step yet. And so they're sort of locked into this cyber stalking charge and also lying to the federal government. One legal issue that comes up on that potentially is the issue of jointer. So there's this doctrine that it basically says if there was a series of criminal actions and you charge someone for some of those actions, you've got to through jointer rules, join in every other alleged crime that you believe took place during that series of events. And if you don't and you just go on the limited charges, even if you win and then later you think you have enough evidence for a charge, the defense might bring a bring up motion to dismiss that more serious charge under jointer rules saying, hey, you should have brought this during the prior prosecution in this in the series of criminal actions that you prosecuted.

I'm not sure that's a winning argument from defense but different justice might see it differently. This is so tough. It's hard not to think there isn't more because it's a pattern of behavior, right? That is in every other case you covered, you're always on covering more, especially when you have allegations by Mike before she passed of bringing homeless into their bedroom. And I think was it her again, correct me if I'm wrong on this? The prostitution aspect of it or there was. It was an allegation from a fraud. It's all allegations. Right, so when you have that kind of leakage coming out of a lot of a porn behavior, the probability that there's more and there's potentially more there is like Eric was saying at the very beginning of some investigation, you'd expect you'd find more in the couple of years they had to investigate this. But disappointingly, we haven't seen it, which is really kind of sad and shocking because there isn't a law for manipulating the living hell out of someone to make them kill themselves. At least not yet there is.

There, there, Mike as law is still being worked through the system. There's another course of control laws attempted to be passed in South Carolina that have all failed in the process. Let's say this does get passed at some point in time here in the relatively near future. If a law is passed like that, Eric, is it retroactive? Is it something where someone could go, well, it's on the books now and we're still technically in a point of where the statute of limitations has not expired on it. I mean, there's two things that would have to be there. Can you do that? Can you retroactively go after somebody for a law that didn't exist at the time that you committed those crimes? You likely cannot. Okay. And the likely provision, I was just looking it up, but I believe it's the ex post facto clause of the Constitution, which basically says that a crime, some action could only be a crime. If it was a crime when it was committed, if it wasn't a crime at that juncture,

but then a year later, a law was passed that would criminalize it. It would not have a retroactive effect. The ex post facto clause, I think, would prohibit any such prosecution. So yeah, too bad. Unfortunately for the victims' families and the community and everything else. So if you do have somebody, let me throw this to you, Rob. And you're an investigator. You're trying to inspire someone to talk that may have information. Are you offering immunity right now in protection? I mean, you gotta consider the type of folks that you're talking to and they slither. They're slimy. They know how to move and weave their way through shit. So, you know, is offering immunity in protection? The key or do you walk in? And I guess it's usually probably not the best approach, but I don't know. Sometimes harsher, maybe the right thing for certain folks. Do you go in threatening with their own indictments? How do you handle that? So it's a process, it's a relationship.

And so I'm sorry, the language you're using, I'm cringing that because if you approach a first contact as syncing your slimy and slimy. I don't know, you're calling, but you're in your mind. I know that these people are. But you can't though. You absolutely cannot because you're gonna have your own leakage about that. Oh, okay, either you say that. So you have to be congruent. And the only thing you're doing in the first meeting with someone is if you, I loved that, you were to use inspire, you have to inspire them to want to cooperate and you have to inspire them to want to share information, not convince because then everything they're sharing is suspect. They have to want to from within them. And so in order to do that, you have to identify before you offer anything, because if that's not their fear factor, their fear point, they will mean nothing. So the first thing to establish is, what would inspire you to feel safe and sharing? That's really what you're trying to establish first is, what can I do? What resources do I have that I can help you overcome whatever reticents you have to share in? And if it's immunity, I can do my best to work on that.

A lot of time, remember, as an investigator, I have no tools whatsoever. I have someone I can go talk to, I have an Eric, I can go talk to, say, hey, Eric, what do you think we might be able to do? I can try to have some things ahead of time that I can negotiate with at this first meeting, but a lot of times I have nothing, because the first thing I have to do is, because no one wants to give anything to get, right from the get-go. So I'm gonna be talking and exploring with the individual that I believe has information, that could be of great public service. I'm offering them an opportunity to do something to great public service or save a lot of people. If that is, is that payment enough? If not, well, if you need to make it something more tangible for you, let me know what that is and I'll see what I can do. But before we even get there, maybe some good will might be that you can give me a little bit something I can go to them and I was saying the value that you do bring. Is that something you're uncomfortable with? If not, let me know. So that's how, see, I'm just playing this out. We're just, we're taking baby steps, walking down here, because what I ultimately have to do is I have to establish a relationship of trust with open-ons communication, transparency, vulnerability.

So they see me as an advocate for their safety, as well as making a difference of something that means something to them. Do you ever run into people where none of that works and the only language they speak is fear and the only thing you can get through to them is like, you're going to prison if you don't fucking talk to us. Absolutely. And here's what you do. You always talk the four keys of communication and you're seeking their thoughts and opinions like we just did. We're gonna talk in terms of their priorities like we just did. We're gonna validate the non-judgmentally with active curiosity to see their point of view with that deep-active empathy. And find the last point to your point right here, Tony, is we're going to empower them with choice about the process they want to move down. I can offer all these great things to mitigate the fear factor they have, but at the end of the day, listen, I need this information in order to do the right just things that I think in the prosecutor to think and the state thinks is really righteous, we're going to move down in this direction. It's your choice about how you want to proceed on this. We can do this in the cooperation where I can mitigate these things. Or here's the hammer, it's gonna be lowered on you.

You tell me which way you want to move, and I'll just tell you what the cause of the effect of your behavior is. You probably get a lot more information by taking the measured route like that versus going and going. This is why, and hence this is why a random behavioral team, this is what we strategy, we so my team never strategize how to get someone. Yeah, we strategized, trust, every single operation because nothing in the government, nothing in prosecutions. I mean, all these data collections, all the trade craft you can do, and the subpoenas, and a title three, and the Fises, get you technical data, which are great tips, great leads, but they don't have the human context most of the times behind them. So having human beings share information on a witness stand, that's where the rubber really meets it. And everything else is a supporting document to me in my world. And so it always came down to always, humans, humans, humans, humans, I need to have humans. Yeah.
