We've looked at how investigators tore through Caleb Flynn's crime scene, but now we have to look at the uphill battle. His defense is facing in Miami County. Caleb claims a phantom burglar broken to his Ford pickup. Stole his 9mm handgun and then broken to the house to execute Ashley while leaving him and his daughters completely untouched. With the judge ruling that his alleged mistress will take the stand. How does this alibi hold up under cross examination?

3:06I mean, continuing our panel discussion here. Former FBI chief, the Behavioral Analysis Program, Robyn Drake and former FBI Special Agent Jennifer Kaufendaffer with us. Let's start with the gun. Jen, you know your weapons and the stories of them. How often is it that someone goes and not only takes the weapon from the home to use in sad crime, but actively finds a hidden one in a vehicle parked in the garage. Is that like it's like in the gun cabinet over a year? We're sitting on the counter and you're like, I'll pick this up and use it. It's like, whoa, I don't know. I don't know how many people put 9mm in their center console. I'm sure some do, but it's kind of a luck of the draw. I would think as to whether you're going to find one or not. What are the odds? Well, that's the thing. People bring what the tools they need to commit their crime.

4:06They don't go into a house and say, boy, I hope there's a 9mm gun here. And let's check the glove compartment just in case it might be there. No one does that. It's so ludicrous. I say that too. Sorry, you're not going to like this maybe. But Ramsey, John Bonet, everything new in her crime was from the house. I'm not going to digress. All I'm going to say is people do not hope that they're murder weapons and their weapons to commit their crimes are at the house. They bring them with them. So it's ludicrous. Can we think of any where we actually have that happening, where we're someone and it was like, no, they actually did that. I can't. I mean, maybe it exists somewhere in the ether. I'll see if there is. But just with burglaries gone sideways with murder committed along the act, it's under 1%, it is 0.004% of burglaries and in homicide.

5:07And that's not even counting. And that's with people who bring the weapon with them. So let me see. On the other hand, it's like that's why people with one marble or half a marble rolling around upstairs doing stupid shit like this. I'm sorry, it's going to be the end of the day in this case is done. Well, I'm going to take a while to guess here. And I mean, it's a Ford pickup truck. I think it's an F-150. I don't know the year of it, but I would imagine that there's going to be the infotainment system on it, like we've seen in so many cases, basically the computer that can tell you a lot of things. When the doors were open, when probably even when the glove box or the middle console was probably open, there's probably something that tracks that electronically. The timing of that, I think, is going to be interesting. If they pulled it, I don't know if they did. I mean, would you imagine that the vehicle data that exists of those sort of things being access, being a part of the trial and the case against him in this case, Jen?

6:09Oh, yeah. I would pull it absolutely. It doesn't necessarily mean that information is going to be there, but you 100% have a specialist again. This is a very unique area that people are very specialized in. And I would definitely have a subject matter expert go through that module and pull every bit of evidence there is for that vehicle. The, you got something there, Robin? Yeah, so the data is going to be a little skewed on this because when you look up amount of burglaries that turn to homicides, that number is low. But if it's a burglary for the intent of stealing weapons, that actually goes a little higher, but it's still extremely low. So again, it's hard to differentiate in the data on it because if people are actually going there looking for weapons, that actually has a higher percentage. Grant, higher percentage, it's 4%. But probably didn't show up to steal a gun, and then it's exactly. Exactly. It's a song. That's the point.

7:09And so in other words, it is so rare, there's no stat on it. How, and just, there's no logical explanation here of there being a third party coming in and doing this. He's cheating on his wife. The judge has handed the defense of Massablo by ruling that Caleb's mistress can come in and testify. He's got thousands of messages with this woman. It's all on his, I mean, at the very least, I mean, even if he flawlessly somehow found a way to get rid of his wife, they're offer. It's still, he's still going to look like the massive number one subject here of a possible suspect for the affair alone. What the hell is going through people's minds like this, thinking that they're going to get away with it when they have, they're just waving the flags of look at me.

8:12I mean, I'm just, I'm amazed. I'm amazed sometimes I was stupid they can be. In situations like this, there's not even much of an attempt to cover this up. But somehow they think I'll just do this and get away with it. Is it like kind of one of those things you're too close to the sun. You've been telling yourself the same bullshit over and over so many times that you believe it. And there's no, in many cases like this, there's no loving critic Robin to step in and say, you know if you're going to kill your wife here, so I might do it. Nobody's giving them the feedback of what it might make this work right. Are you, I don't know, I'm just kind of baffled by the intensity, the affair, the obviousness of the affair and then carrying out a crime like this, thinking that he's going to get away with it. But these are the cases we talk about every day, Jen. Well, you know, the problem is that all of us in law enforcement that see this over and over and over again, this isn't at all surprising, you know, it just isn't every sort of crime.

9:14People think they're going to get away with it. And it goes something like this. He is absolutely hell-bent on being with this woman. And that has overtaken every sense of sensibility that he might have had. And so now he's completely, that is where his brain is, every day, every minute, and that's where his emotion is. And that's why he becomes hateful toward the wife because she is in the way of that. The kids aren't in the way. The dog isn't in the way. Money isn't in the way. She is in the way. So now it transforms all that love and lust and everything he has for the woman now turns to hate on the obstacle in the way. Then the mind starts churning. How can I get rid of this obstacle without hurting my chances on being with the woman? And it just keeps going and going until it comes up with some theory that it thinks it can live with

10:16that makes some semblance of sense only it really doesn't because it is so blackened out by the lust and the hate. That's my thing. Yeah, something happened. 100% I think something happened in that 2021 year time frame where something went sideways from the arc he was on and the life he was living that created this situation where he's now got to go work for the father-in-law and do something he wasn't doing his entire life. So when that starts happening as Jim was saying the hate and the lust and all that thing and then I would imagine that again pure conjecture, you know, who knows we're not him but you can see from the data here that things like the emotion of resentment start entering there and we have these negative emotions and they start spooling around in our head without a loving critic in our lives or anyone healthy saying hey, something's going sideways or you were surrounded by healthy people say the in-laws are healthy they're trying to help out but you're doing something or something happened to you that your brain is changed in some way

11:23who knows what will come out in this trial but typically so here's what we've seen in the past. We see a major deviation in someone's behavior over time and at a certain specific time period like this where you're like what the hell happened here? Someone was ingesting something typically that gets them off the rails. I don't know we'll see what happens. I'm wondering about the kids because they are going to be testifying it's I guess going to be audio only and it's not going to be broadcast so we'll just hear a transcription of what was said. What do you think they're going to offer to the prosecution here of this? Do you think this is going to be more so information like you were saying Robin of kind of that 21 area the life before the crime more so than the actual event of the night itself. I don't know how much they have to offer up that night. Maybe they have some stuff. I don't know maybe before bed like daddy went to the garage. I don't know who knows what they're going to say but Jen what do you

12:28it's heartbreaking that the preteen girls they have to go up and testify to begin with but I get it you know they were the only other witnesses here that night. What do you think they have to offer behind beyond? I mean the already mountains of very damning evidence against Caleb. First of all I think the scope will be very limited. I do not think we're going to get into some big history or historic recitation of their life together or anything like that. I really think the prosecution will keep it focused on that night but I want to know things like this. Speaking about deviation. Did daddy say hey let's have a binadural tonight. Did daddy change the night routine in any way obviously we know he slept on the couch and then later he said he went in with the girls. Did that ever happen before? Was this just this night?

13:30So I think they're going to keep it very focused to this night and look for any anomalies that might have happened leading up to and then also after the crime. Yeah good point I agree. It's looking for a deviation from that norm on that night and keep it very focused very specific I agree Jen. You got to be careful though when you're talking to kids about did like did daddy have you take night well or did did whether anything different this night about the other nights because sometimes kids will just say yes sometimes kids will just say no even if that's not what exactly happened. How do you get there without basically placing the piece of information to which you're looking to see if it happened into the subject line of the sentence where the kid could just be like yeah all right we took a night well maybe they didn't know so you don't lead it you just say tell me about the night and they tell you about the night and say did that night different than

14:30any other nights. Yeah and to be clear this question has been asked and answered probably 20 times they already know what they anticipate the person will say. So it's it will not be the first rodeo as far as questioning at all that these kids have seen but to your point Tony kids and adults change all the time like you're interviewing you've interviewed them 10 times and then all of a sudden they get up on the stand and you hear something you never heard before you're like wait a minute. Do you imagine that because it's going to be it's going to be important you know especially when you're dealing with kids in the context they have this is dad this is mom you unlike Cory Richards kids we didn't know what you're going to hear from them until we actually heard them doing the the victim witness statements were like oh my god they were definitely not on her side. There's the same thing here you don't know why you know what where they stand in alliances and that's why I keep it to the facts and data of their observations only without without trying to lead them to a conclusion about what that means and so that's I think Jen's point is really spot on

15:32with is going to be narrow and scope probably to that night of just what what what happened and what was different if anything none of us are attorneys here but let's pretend we are for a moment let's pretend we're defense attorneys do you play the God card with Caleb Flynn do you go he's a man of God he's been a worship leader he's devoted his life he's he's dedicated his life to helping others find the Lord or whatever play it up that way do you go down that road or is that a really risky one to go down where people are going to go oh thanks for placating me on this bullshit where you could have somebody else gone he's a man of God I mean you could you could really you could go either way depending on the person who's receiving that information it could be incredibly powerful it could be one of those things that makes somebody hold out on a jury because they fully believe well this man of God can never do anything wrong or you could be wow well he's more suspect because he claims to be a man of God and he does all this horrible shit over here and I've seen that story

16:33a thousand times I mean it's kind of a world of the dice what do you do Jen well this is why I'm not a defense attorney and I last it about two days on my defense attorney internship uh I'm sorry I'm gonna have to but nevertheless uh absolutely this defense attorney I think we'll try to play a card like that about what a wonderful person this has been he's been a man of God blah blah blah blah hoping hoping that he just gets one jur that somehow feels for this person so I think we can expect it it's just what defense attorneys do sure I would be curious whether to actually use the term um pass or anything in there or or religion in particular I think you you could easily just talk about the life of service of of that calling he's had and serving and and actually family
