And the Kelsey Fitzsimmons manager, Dr. 2025-77CR311, all counsel and the defendant of the president. Thank you. So, before I begin, I'd like to speak to our audience members.
I understand that this case has generated a lot of passion and emotion. But you must remember that this is a footprint in our sports arena. Well, I am not so sure that you must not act motionally or physically or automatically react. So, you should leave the courtroom if you believe that you will be unable to blame your conclusion. I'd like to start with a few interesting introductory words. Let me say this is not in my script. This has been one of the more exhausting, harvest things I've had in here as a judge. I think I've had to turn it and then I'll turn it up.
So, as the lawyers know, unlike what a judge presides over a dirty grave trial in a civil case, there is no requirement that a judge just blame their reasons for reaching the verdict after a criminal bench time. I do so in this case because I think that this had sentenced officer to human. There are all the people involved in the tragic events of June 30, 2025. I've deserved an explanation. Next, I'd like to take the opportunity to possibly thank and commend the attorneys in this case. They all did that sexual job as acting the evidence, conducting themselves into extremely professional and civil manner. And they did so under public, under the public spotlight in an emotionally charged case. I commend to the extent that any of the prosecutors, the attorneys may be vilified or subjected to public scorn for simply doing their jobs. In this case, I say
that they did such scorn as unfair and morbid and simply wrong. These prosecutors in the attorneys are hard, but form their solid jobs fairly with the utmost civility and professionalism. They shunned as a shining example of our adversarial system in operation. Now, I'd like to publicly acknowledge the crucial and often thank this role that police officers perform. A role that citizens herself, like officer William Lee and selflessly, performed for the citizens of Norseando. For this, you should be thanked, not disparaged. For those that think certain that serving as a police officer is easy, or that officers don't care or take pride of their work, I say with one of these three decades of experience in criminal justice system,
that you are naive, misinformed and sadly mistaken. The work of police officers is especially fought with peril today, because of our seemingly central polarized atmosphere, where our citizen pretty often believes that there is a conspiracy under, we're corralling it in the corner. I saw no evidence of a conspiracy in this case. What I saw was dedicated public servants, like officer William Lee and his fellow officers were doing the best they could under tragic, rapidly evolving commotion of circumstances. What I also saw was a young woman, Ms. Fitzsimmons, who was also a dedicated public servant, reacting to sudden, confusing, and heartbreaking news. Now let me turn to the evidence in the law. Our system of justice requires you to decide this case, only on the law and the evidence.
So the only things I have considered in reaching my further, on the 90th and 6th, it's admitted during the trial, and the testimony of the 11 witnesses that testified there in open court. While it may be cold and unmeach hearing, our system of justice commands that emotion, sympathy, and concern for the consequences of my decision, play no role in my decision. As for the law, in order to prove Ms. Fitzsimmons guilty of the crime of assault, by means of a dangerous weapon, the connoble who has proved the fall home three things, reborious, obvious things, elements, beyond the reasons of that. First, that Mr. Fitzsimmons committed in assault on a officer doing second, that Mr. Fitzsimmons intended to commit the assault in third, that the assault was committed by me to begin to escape. The assault they should be for me is whether the connoble proved to be elements beyond a reasonable doubt. And more specifically,
under the circumstances of this case, the narrow issue for me is whether the connoble proved beyond a reasonable doubt that Mr. Fitzsimmons appointed a firearm at the office of your meeting for any perceptible amount of time. What is not before me are the legality of the issuance of the restraining order to Mr. Alec Alec. The reason for this of the procedure used by the police to serve the restraining, the legality of officer meeting to use a force in issues regarding the custody of your case. It has got my place to decide these issues, or even mention my thoughts on them. I am thankful for this because my role has been hard enough. What has made my job especially difficult in this case is that by and in March, I found the testimony of officer room in Mr. Fitzsimmons to be credible on the tiered up in a relevant point. In my experience, this is unusual in somewhat perplexing. On the one hand, Mr. Fitzsimmons
incredibly testified that she never pointed a firearm at officer meeting. On the other hand, officer meeting testified that not only did Mr. Fitzsimmons point a gun at him that she also pulled the trigger. Both agreed that it happened in seconds near a narrow door way. In the crime scene photo show that the door frame was made narrower by a closed wrap contained police uniforms that was to officer union was left. The door frame was also made, the door frame was made still narrower when officer meeting used it to take cover working through this firelock. During the closing argument, Kamal argued that it was scientifically and physically impossible for Mr. Fitzsimmons to be true because there was a bullet in the chamber that she said that officer meeting shot her without ever having wrapped her wrap in the slide after pulling
the trigger. I just think that the evidence reflected that the only way to chamber wound would have been to pull the slide under those circumstances. However, even if I assume that Mr. Fitzsimmons lied about not backing the slide does not trap from the adamant seat in credibility of her testimony that she never pointed on at officer meeting, about which he was equally as adamant that she did. Perhaps the Kamal could have easily met its burden that the officers had been wearing bodies. But under these circumstances, I am left with a reasonable doubt and I am duty-bound to find that the Kamal had not led its burdens through, but his foot's singing is committed in the song by means of the dangerous weapon on officer union and my verdict is it must be not killed with that. I will hand the signed verdicts. I will hand the signed verdicts to Mr.
Grovering and ask that he advise Mr. Fitzsimmons of her statutory rights. Mr. Fitzsimmons, it's going to please stand. On top of 2025, 777-311-001, the court having returned a verdict of not guilty, the court ordered that you be discharged with this indictment and this indictment only and go there without delay. Kelsey Fitzsimmons, as required by statute, I must inform you that the records regarding the charges for which you have been found not guilty will be sealed by the Commissioner of Probation and by the court unless you notify the Commissioner of Probation in writing within 10 days that you do not want those records sealed. To request that those records not be sealed, you may use the request not to seal the warrant posted. I'm on the draw course webpage on Mass.gov or a copy of the picture I will hand to your counsel.
