Because as we know, Divorce happens and then you start fresh. I'm Olivia Howell and this is Divorce 101A2Z. We're here to break down confusing Divorce terms so that anyone can understand them. Whether you're in the thick of it, just thinking about Divorce or supporting someone you love. Today's episode is brought to you by the letter Y and the number 3. Y is for your best interest standard. And the number 3 is a reminder that when courts make decisions about children, they're usually looking at three core things, needs, safety, and stability.

Let's start super simple. What is the best interest standard? The best interest standard is the legal framework judges used when making decisions about children in Divorce and custody cases. It means the court is not deciding based on what feels fair to the parents, who is more upset, who files first, who argues louder, who deserves more time, instead the court asks one central question. What arrangement best supports this child's well-being? Every custody, visitation, and parenting decision flows from this standard. While each state has its own detailed list, most best interest analysis fall into three main categories. Number 1. The Child's Needs. This includes the emotional needs, the developmental stage of the child, educational consistency, medical

or therapeutic needs, daily routines. Judges look at who has historically met these needs. How each parent supports growth and regulation. Whether the child's world will remain predictable. Number 2. The Child Safety. Safety always comes first. This includes physical safety, emotional safety, exposure to conflict, substance use concerns, domestic violence, mental health stability. If there is a safety concern, it outweighs everything else. And number 3. The Child's Stability. It refers to school continuity, community ties, familiar routines, consistent caregiving, predictable schedules. The court is not looking for perfection. It's looking for steadiness. The best interest standard is not about being the better parent.

It is not about winning. It is not about proving your ex is bad. It is not about punishing anyone. It is about protecting a child's right to grow up feeling safe, supported and secure. For many parents, the phrase best interest of the child can feel terrifying. You might worry, what if the court doesn't see me? What if I misunderstood? What if my child loses stability? And here's the truth. Courts are imperfect, systems are imperfect. But this standard exists to center the child, not adult conflict. When you align your decisions with your child's needs, safety and stability, you're already working with them as framework. Since today's number is 3, here's your grounding step. Write down 3 things your child needs most right now. For example, predictable routines, reduced conflict, emotional reassurance, consistent
