
Bryan Kohberger’s “Broken Plea”: Can He Take It Back?

Joshua Ritter is joined by Idaho Statesman investigative reporter Kevin Fixler to break down the stunning news that Bryan Kohberger wants to withdraw his guilty plea and seek a trial in the Idaho student murders case.
More than a year after pleading guilty to murdering Madison Mogen, Kaylee Goncalves, Xana Kernodle and Ethan Chapin, Kohberger is now declaring his innocence and calling his plea “broken.” In a new statement, he says the plea was based on “false promises and blatant disinformation,” declares his intention to enter a not-guilty plea and says he is willing to risk the death penalty at trial.
Kevin, who has covered the case extensively since the investigation began, joins Josh to discuss Kohberger’s statement, what he is alleging and what could happen next. Josh analyzes whether Kohberger has any realistic path to withdraw his plea after sentencing, what he would have to prove and whether the state could seek the death penalty again if the plea were overturned.
Then, Josh is joined by criminal defense attorney Elyse Hershon, Esq., to analyze Day 1 of the Lindsay Clancy murder trial, including opening statements and the testimony of Clancy’s ex-husband, Patrick Clancy. They break down the prosecution’s argument that the killings were planned and deliberate, the defense’s claim that Clancy was suffering from postpartum psychosis and whether Patrick’s testimony may have helped the prosecution or the defense.
