Lindsay Clancy Verdict Watch: Is a Mistrial Coming?

I know that we're coming at you a little bit unplanned so I appreciate you all for being here. If you are just joining us for the first time on courtroom confidential let me introduce myself my name is Joshua Ritter. I'm a former prosecutor with the LA District Attorney's Office. I was there for 10 years before

1:02I left to go into private practice as a criminal defense attorney and this is courtroom confidential where we do our best to bring you both sides of the courtroom both sides of the issues both sides of the story and today is something a little bit different. Usually we have a very planned and set time and I'm inside of a studio and we're going to have a guest and everything else but now today I am sitting outside of the Plymouth Superior Court waiting on the Lindsey Clancy Drew. So we thought what a better place what a better time than to come to live right now and talk to you about the latest developments in this case. So that's exactly what we're going to do. Plus we've got some developments in the Tyler Robinson case another case that we've been following very closely and I'm in a warning role because this is a breaking news day the jurors are on a break right now they're at lunch we don't know if that still means they're working or not we know that the courtroom is shut down meaning if they have a note if they have a verdict the judge is saying it's going to have to wait till after that noon hour so that they or after that 1 p.m. hour so that they can give the

2:02courtroom staff a break which I'm hoping is a safe time for us to do this but if something happens and some breaking news takes place they're going to kick me out of here and probably throw me on TV so just bear with me if that happens. Anyhow we're going to talk a little bit about the Tyler Robinson case as well but let's get into the Lindsey Clancy case. So you remember we've only heard from this jury twice one we heard from them a few days ago when they asked for two pieces of physical evidence they wanted the bag with her prescription bottles in it and they wanted to see the physical night why they wanted that is still a curiosity still a mystery to all of us the only thing I can figure is they maybe wanted to see the sharpness of the night to to determine whether or not somebody could make a legitimate attempt at their life with that night why they would want to see the pill bottles I don't know I've heard people suggest well they wanted to see how much of it she used they know that it was testified to

3:06they've they know how much of each of those bottles was missing why they would need to see the physical bottles beyond me but that was a few days ago yesterday morning they send out a note saying that they are hung that they are in in pass that they can't come to a verdict the judge swiftly sends them back into the deliberation room says I hear you but this case has gone on for a long time we've heard from over 80 different witnesses 300 different exhibits go ahead and talk about this a little bit more I know it's a difficult case and since then not shocking that they came out and said that they're at an impasse what shocking is that since then it's been absolute crickets not a word from them I would have thought if they were really legitimately at an impasse that we might have heard from them again perhaps yesterday afternoon saying hey judge we worked all day we're still at the same spot no movement sorry we've done our best or my thinking was that the reason that we heard from them yesterday morning was that they probably felt that way the day

4:08before in the evening and they said you know what let's sleep on it we'd feel the same in the morning we'll tell the judge and that's what they did if that was true you would expect that we would hear the same thing this morning that they would have said listen we worked all day yesterday we're still at an impasse judge send us home we just can't do this but nothing all morning long nothing they're now into their lunch break and nothing which to me indicates there's probably movement and probably movement towards a verdict you would imagine if they were very evenly split and there was no movement we would have heard back from them you would imagine if they were split and it went towards being more split we would have heard from them but you have to guess and I think this is you know we're all doing our best to read the tea leaves but you would have to guess that they're moving towards something unanimous if they're continuing to spend time back there one other thing though that did take place this morning was interesting the judge had this comment to say to the

5:12jurors when he first brought them in it's a little bit vague let's hear what the judge said and then we'll break down why and what might have inspired him to give this instruction to everyone before before you go and I just wanted to make one comment look without an editorial comment I just want to remind everybody here and elsewhere there's been an order it's been issued in regards to conducting of this case as well as statutes in this Commonwealth which relate to jurors, witnesses, attorneys and others in regards to this proceeding and everybody should be well aware that those that order and that statute is being enforced and will be enforced so I just kind of wanted to put that out there with no follow-up or editorial comment so what order what statue what is this the judge going on about here well it is helpful to understand the context of what

6:12took place uh yesterday as well uh we found out that uh a woman who's not connected to any kind of media organization was here uh my understanding issue was holding up a sign but also using her phone to videotape the judge has been very strict about no contact with the jurors no attempts to take photographs of the jurors no attempts to take video of the jurors and in fact the way this courtroom is set up if you can see behind me here if you were to walk all the way past the courthouse that way there's an entire other parking lot that's with the jurors and the courtroom staff um park we're not allowed back to all of the media is on this side of the building and all of the public is on this side of the building and we're instructed to not even go that way this woman was apparently her name is Dawn Light she got arrested for that she was actually a reigned today she's pled not guilty to aggravated intimidation of a court officer or witness here it's the the jury she says she was

7:18only attempting to film Clancy tell me how that makes any kind of sense Clancy Lindsay Clancy isn't walking out of the courtroom every day she's not she's in wheelchair first of all she's not coming and going from outside of the courtroom she's being transported in in a secure facility in a secure van she's being taken in through the custody gate where all the jail people who are in custody go she's not this is not something where every morning we see Lindsay Clancy entering and exiting the building so that doesn't really fly with me and they did find on her phone video that depicted some of the jurors so the judge was obviously very concerned about this you don't want to get to this final stage in deliberations and have this whole thing thrown out the window because of some person decided to interject themselves into the story so that was what the instruction I think was alluding to the reason why the judge wasn't more direct about it is because he's not aware of the jurors even knew about this even knew about this woman was aware that what she was doing

8:23or was aware that she even got arrested and he does certainly doesn't want to alert them to a troubling situation if they're not all already aware of it they went to sidebar the juror the the attorneys then my guess is must have convinced the judge that they need to speak to each individual juror each juror individually and that's what they did the judge question each of them again we don't know what the questioning was about but he questioned each of the jurors individually and then that was the last that we heard of it I imagine he questioned each of them to ask them are you aware of any person who have you out you know felt like you've been photographed or felt like anybody's been watching or are you aware of this arrest anyhow that's kind of the big news of what took today she was like I said this woman Dawn light was a reigned she's looking at heavy duty prison time I don't think that will actually happen I think they they they just want to send a signal to to don't do this to to make sure that other people aren't going to try to be as cute

9:29I don't think she's actually looking at present time but with these charges it's a 20-year exposure I mean it's heavy duty stuff so a reason for everybody to pay attention to the the judge's orders I'll tell you too since I've been here state police have come out more than once to remind everyone to behave themselves that this this this entire area I wish I could show you when I first came out here a couple weeks ago there was maybe ourselves and a couple of other media present now it is an army camp worth of media set up here dozens of different outlets from all of the country all of the world every time for Kevin Reddington leaves or goes inside of that courtroom a scrum of of media with microphones in his face there's obviously a lot of attention on this case and we know why that is so here we are day number five they've been deliberating for over 26 hours

10:32and we haven't heard from them so what do I make of all of that everybody's asking when do we think when do you think we'll hear from someone when do we're where do you think what do you think this means who knows that's the answer everybody who knows you you welcome to the favor of past on a beverage trial attorney which is trying to understand which yours are doing who knows that's something uncertain of who knows here's what I'll give you my best guess I know from experience that many times jurors are initially polite with each other and they want to respect each other's opinions these are strangers to each other remember so they get back there they talk about the case they get to a point where they're like well let's vote not guilty or not and maybe they end up split and they go okay well I respect your opinion I don't agree with you but I respect it sounds like we're at an impasse sounds like we're deadlocked let's let the judge know and then they do

11:34and then the judge goes not so fast that's not the way it works get back there get back there and work get back there and talk to each other and then the temperature gets turned up a little bit and then they realize okay that's not we don't have an easy ticket out of here let's actually sit down and get to work and perhaps people have to defend their position on something do you imagine if things are split you know more along the lines of a majority and minority view in there 10 to 2 11 to 1 they're going to turn to those two jurors and say well explain to us your position defend for us why you feel this way that is different from the rest of us and maybe that convinces someone that they don't have as strong an opinion on that thing as they did to me the silence since that first note is a bigger deal than the first note I'm not surprised I said this from the beginning we're going to hear from them at one point saying that they're deadlocked I'm not surprised that they've told us that what I am surprised at is that since they told us that we've heard nothing which to me

12:39again doesn't mean that they're heading towards a further divide doesn't mean they they went from 10 to 6 6 it means that they likely have movement that they feel it's fruitful to continue to talk if they're at you know 9-3 and then they go after they sat and talk about it now they're at 10-2 they go okay well maybe this is worth talking about it maybe they move to 11-1 maybe we're getting closer to a verdict what will surprise me though is if we don't hear anything from them today like I said they're on a lunch break I got it will imagine we're going to hear something by this afternoon does that mean if verdict who knows does that mean they say that they're deadlocked again who knows I just have to imagine some communication that would really be surprising to me if a verdict comes down obviously we know how things are going to end we're going to hear they're going to tell us what you should have they convicted or what have they

13:41convicted or of is it not guilty by reason of it's ended it's locked again that's where things you get interesting and that's where the judge can start to consider other options is there something you might want to hear is there evidence that is not clear to you do you want read back on witness testimony is the law confusing to you help us help you or the judge can simply do what he what we've seen before and give what's you know in Massachusetts they refer to as a two-e Rodriguez instruction federally it's called an Allen instruction you may have referred to it as a dynamite charge all it is is kind of the idea of telling people to reevaluate their own positions that if you are not doing this with an open mind then you're not doing it in an honest and straightforward way that we expect a few go back there give it your final one last best shot now in the state of Massachusetts after the judge gives that instruction if they come back again and say we're deadlocked

14:46the judge cannot force them to go back in unless they want to so the judge could say do you feel further deliberation would be helpful and if they say no we're at a mistrial the judge should declare them deadlocked and he should declare a mistrial so could that happen this afternoon perhaps we're like we're also running late on time here they've only got about three more hours I think to do this so he could come back send him back with that dynamite charge they could come back later on today say we're still deadlocked and then we might see a mistrial today my best guess is even if this is headed towards a deadlocked mistrial that it probably will not be declared until tomorrow and know that disappoints a lot of you but I just that's my that's the that's me doing one of these things and just kind of taking the temperature and reading the wind and doing my best to guess what's going to happen here let's talk really quickly though about another case first of all let me

16:51back in court this is how crazy things have been for me lately I was planning on being in provo yesterday but because of what's going on here with Lindsey Clancy I wasn't in either location I was waiting with a van at my house to just to figure out where I was flying to next turns out Lindsey Clancy didn't get a verdict so I was not able to go to provo but still we had some movement in this case in provo now nothing shocking took place in this case this was the opportunity for both sides to be heard on the preliminary hearing which took five days a couple of months ago a very convincing overwhelming amount of evidence in support of the prosecution's theory that Tyler Robinson is responsible for this assassination no shock that the judge did in fact spoiler alert hold him to answer for every count that he's been charged with including the aggravating circumstance

17:52that allows for the death penalty in this case what is shocking but shouldn't be shocking to me is how long this all took they didn't get to this until late in the day in provo you talk the attorneys first had to argue about cameras in the courtroom once again once again more argument about cameras in the courtroom you would think that these attorneys are being paid a bonus if they get the cameras outside of the courtroom with the amount of time that they are spending on talking about cameras inside of the courtroom I just want to scream at the talking of my lungs forget about the noise and get to the work cameras in the courtroom it's not going to be the end by the way we're going to hear it again cameras in the courtroom cameras in the courtroom judge finally puts that to rest for the day I'm not going to I'm not going to I'm going to allow cameras in the program so then we get to the actual substance of the pre-level both sides had an opportunity they

18:57think their arguments they argued for an hour they argue for an hour each by the way everybody after we had had a five day long pre-lim and they had all filed briefs in support of their positions that's how exhaustive this whole process has been and then the judge needs time to go back and consider everything and then spent to call this judge comprehensive while is true is not a real accurate description of what's going on here it is troubling how long it takes to do everything in this case and how long that ruling took we were going to try to show you a clip we'd be here till tomorrow if I actually showed you the clip here's the best we could do to distill his ruling which by the way I've done hundreds of pre-lots you have the pre-lim both sides argue for a few minutes at the

19:59end and then the judge goes thank you for all of that uh based upon the evidence in the standard before me I believe there's enough probable cause to hold the defense of the answer when do you guys want your next pre-trial date that's how long it takes here's the best we could do to distill that down this ruling that took place over several minutes yesterday for the four going reasons and based off the record and parties submissions it is hereby ordered that the defendant Tyler James Rauvenson is bound over for trial in the fourth judicial district court there you go 13 seconds that's what it should have been you see how long 13 seconds that's what it should have taken instead it took I'm gray in the head and I got grayer listening to this all take place um the Kirk family had this to say I don't want them to be lost in all of this every step in this process carries the weight of all that Charlie's murder has taken from his family especially his children
