From ABC News, World Headquarters in New York, this is World News Tonight with David New York. Good evening, I'm Wade Johnson and for David tonight. We begin with breaking news, a mistrile declared in the Lindsey Clancy Murder Case, the stunning decision coming down after a dramatic series of twists and turns. Jurors telling the judge with a heavy heart they were unable to reach a unanimous decision. On the charges related to the killings of Clancy's three children. The defense attorney making a last-ditch effort to avoid a mistrile, but the Massachusetts High Court denying the appeal.

3:06The high profile case captivating millions and shining a spotlight on postpartum mental health. Now the legal teams on both sides preparing for what happens next. ABC's chief investigative correspondent Aaron Kutursky leads us off from the courthouse again tonight. Court, all rise to his victory. Tonight with a divided country on the edge of its seat, the stunning outcome of a gut-wrenching case against a Massachusetts mother who did the unthinkable. Nearly 40 hours of deliberations over seven days brought the jury in the Lindsey Clancy trial to this. It is with a heavy heart that we report we are unable to come to a unanimous decision and will not be able to. The jury deadlocked for days unable to decide whether she strangled her children intentionally or because she was suffering from postpartum psychosis. I don't feel I have any choice but to declare a mistrile. It touched off a flurry of legal drama. Clancy's attorney asking the state's highest court to intervene to get a hold out juror kicked off the case. This individual for some reason what it is we don't know but is is taking a position that's intractable regardless of proof beyond a reason to go.

4:15A single justice convened an emergency hearing online. I have before me an emergency request for relief by the petitioner Lindsey Clancy. Lindsey Clancy looking on. Ultimately the issue was was the juror misconduct an inability to follow the law or whether instead this juror had a disagreement as to the facts and how to apply it to the law. The Massachusetts Supreme Judicial Court declined to get involved clearing the way for the judge to end the case. Members of the jury at this point I'm going to declare that the jury is deadlocked and I'm going to declare a mistrile. The court has looked frustrated and defeated Clancy's supporters visibly upset but outside court the district attorney said the focus belonged on Clancy's children five year old Kora three year old Dawson and eight month old Callan. This is a case about three children who died of a violent and horrific death at the hands of the person who showed them the most.

5:15The defense says she does love her kids. It's not right what she had to go through because she greaves the loss of those three children. Kora Dawson and Callan. Kevin for everything the trial brought up we heard from the district attorney the victims are the children and not your client. Can you respond to that? My client is well aware of the fact that we have three kids who she loves, loves dealing with the victims in this case. An incredibly painful and difficult case. Aaron Kutursky joining us now. Aaron the defense seems confident about how they tried their case. So what are the next steps here? Clancy's attorney is now considering an appeal in federal court with over that hold out juror the district attorney must decide whether to retry the case. There's a hearing here on that at the end of the month but with nothing that happens in any court is going to restore this broken family. Lindsay Clancy is back at a state mental health hospital tonight and her children are gone.

6:17All right Aaron and we appreciate you reporting throughout this trial and tuning tonight for a special edition of 2020 the trial of Lindsay Clancy airing at 9 p.m. Eastern right here on ABC. We move on now to the shocking moments on an American Airlines flight a passenger duct tape to the seat his hands restrained the flight diverted the airline tonight accusing the man of being disruptive. Here's ABC's Pierre Thomas. Tonight a shocking image when an American Airlines flight traveling from Dallas to Newark had to divert to Baltimore with this passenger allegedly becoming so unruly he was confronted by passengers and then physically restrained with duct tape. I think once it became physical one immediately knew that action had to be taken he got up right away and and jumped in the seat right next to the passenger and began working on restraining him in order to keep the situation contained.

7:17You can see the man right there all tied up in this photo obtained by TMZ and also tried to bite me so the situation was was getting more intense as as time went on and so while we were trying to restrain this gentleman. One we were handed zip ties by the flight attendant that man now facing state charges and the FBI is investigating American Airlines telling ABC news restraints may be used when necessary to maintain the safety and security of everyone on board. Consisted with industry practice restraint cuffs and tape are included in the flight attendant service kit. The passenger was taken off the plane and the flight continued on the way to Newark with all right Pierre Thomas or thanks to you tonight now to the deadly confrontation. High up on the iconic Brooklyn bridge police shooting and killing a man they say charged them with the knife. Here's ABC's Matt Rivers.

8:17Tonight the deadly and terrifying police standoff hundreds of feet in the air on New York's iconic Brooklyn bridge ending in gunfire. Dramatic video showing NYPD officers confronting a man with a knife overnight as he tightrope one of the bridge's main cables threatening to jump. Those specially trained officers tethered to the bridge for safety attempting to negotiate with the man. They observed that the male was holding a knife and he stated to them, I want to die. I want you to kill me. I have a bomb. After nearly an hour, the suspect appearing to charge toward police knife pointed officers opening fire killing it. It comes just days after the NYPD shot and killed a woman. They say staff two people in Times Square, one of the stabbing victims Aaron Pia sentine died. Her family says it was her first day back at work from maternity leave and went back to that deadly standoff there on the Brooklyn bridge behind me. NYPD officers shooting a man armed with the knife. The city says it will release body camera video with all right. Matt Rivers for tonight.

9:23Thank you. Now to another round of dangerous storms, just as millions of Americans are on the move for the long holiday weekend. Those powerful storms bearing down from the Midwest to the mid Atlantic, torrential rain, strong winds and lightning. And it comes as drivers face record high gas prices for Labor Day. Here's ABC's senior meteorologist, Lee Goldberg. Tonight, destructive storms blasting the Midwest and East Coast right now with millions on the move for the holiday weekend. In Washington, DC, torrential rain and powerful winds topping 60 miles per hour, ripping down more than 300 trees, toppling them onto cars and homes. Late today, officials confirming a tornado slammed Detroit's east side the first to hit the city in nearly 30 years. In Pittsburgh, widespread flash flooding after more than two inches of rain fell in less than an hour, a new daily record. Near Akron, Ohio, first responders rescuing families from flooded homes. Tonight, thousands of flights delayed for a third straight day. And families hitting the road for this holiday.

10:24Let's not talk about the gas prices. Okay. Paying an average of $4.12 cents a gallon, the highest price ever heading into Labor Day. It's scary. I'll just say I just pulled up and I didn't expect to see 457 for regular gas right now. Let's get right to Lee Goldberg. So Lee, many of these same areas bracing for another wave of severe storms as the holiday weekend kicks off. Indeed, Whit. It's been the theme of the summer rounds of storms. DC and the clear now big storms near Richmond of the outer banks of North Carolina. That's where we have a severe thunderstorm watch. Across the mid Atlantic for rounds of storms. We even have more storms than Detroit area possible tonight. Tomorrow, that threats farther south is from eastern Kentucky to the Carolinas anywhere from Lexington all the way to Murdle Beach. On to the temperatures driving this heat and the storms. You see triple-digit feel like readings from the plains of the Carolinas. Thankfully, more comfortable airplaces like Chicago all the way into New York City in the 70s Sunday. And Monday, it's not bad in DC and Raleigh as well to the Pacific. Hurricane's Corrina and Low kicking up Serpent, Hawaii. Corrina weekends and stays away, but Low could briefly go cat-five.

11:26Takes a sharp turn to the north, hopefully staying west of the islands, but certainly some wind waves and rain likely. Whit. All right, Lee, thank you for that. Next tonight, Democrats blasting the latest comments from President Trump calling the war with Iran small potatoes. Those remarks after being asked about JD Vance's recent words on the ongoing conflict. ABC's J.O. Bryan at the White House tonight. Tonight, less than 24 hours after his vice president refused to say the U.S. was at war with Iran. President Trump calling the conflict that's taken the lives of 18 Americans small potatoes. Arachael Scott pressing the president. Can you explain to the American people if this is not a war, what exactly is it? Well, I'll tell you what, a lot of people don't call it a war. I call it a military conflict because it's small potatoes for us. It's not a big thing. The certainly doesn't feel like small potatoes. 18 service members have died. We're seeing record-long deployments. You initially said this last. Why is it record-long, so long? 80-second air bull is now at 8.70 a year. How long will we end Vietnam?

12:27Trump later acknowledging the human toll of this war. We lost 18 souls, 18 great souls. I was there to greet the families of those people that dove over and they're great. It comes as the war is driving fuel costs sky high. Diesel, the lifeblood of the U.S. supply chain, reaching a new record high, pushing up prices on everything from groceries to clothes to furniture. But today, President Trump touting a bright spot for the economy, a stronger than expected jobs report showing unemployment holding steady at just above 4%. It's been amazing. And today, they announced 162,000 jobs, new jobs. And Democrats are pouncing on those comments from the President talking about that conflict with Iran that's cost the lives of Americans calling it small potatoes. The top Democrat in the Senate, Chuck Schumer, saying tonight there's, quote, nothing small about it. All right, J.O. Bryan at the White House. Thank you. Now, to the incredible rescues in flood ravage Nepal, two men found a live pulled from a tunnel that was blocked for more than a week.

13:27Details on this delicate mission and the operation to reach more stranded survivors. Here's ABC's Lama Hassan. Tonight, a remarkable rescue. Nepal's army teams hoisting two men out alive nine days after being trapped in a buried tunnel at a hydropower plot. From his stretcher, Sanjay Sa says he stayed behind to warn at least 40 other workers right before the flood. Not sure how many made it out that apocalyptic flash flood triggered by a melting glacier swept through Nepal, killing more than 1200 people, and burying everything in its path with more than 5,000 still missing. Our strategy rescue operation is going on. And now stranded survivors using a makeshift zip line and basket to ferry people and vital supplies across the still raging Trishuli River. And in a race against time, oxygen now is being pumped into other blocked hydropower tunnels in hopes of helping more survivors.

14:28Witt. Lama Hassan, thank you. Now, to a bombshell court rolling former NFL players, clear to go back to college and play for LSU despite legal challenges. A stunning decision as week one of the college football season kicks off. Here's ABC's Perry Russell. Tony N. Zan touched down tonight. A college football eligibility fight over whether former professional players cut by the NFL can come back to college and play again. LSU recruiting two former pro players to the school, but the southeastern conference and NCAA say that is not allowed. Now, Louisiana judge is siding with the players, issuing a preliminary injunction clearing the way for Xavier Harris and De Kwan Wright to play for the Tigers. Tony Clay in the attorney representing the athletes celebrating the ruling. Justice reserved for the SEC. It was served like a cold cup of gumbo. But the SEC says it disagrees with the court's decision and is taking the fight to federal court.

15:28The SEC filing a lawsuit against LSU, arguing its rules have long prevent to professional athletes from returning to college sports. And it's lawsuit the SEC accuses LSU of seeing the rules as an opportunity to be exploited. LSU's president today calling on Congress to step in saying college football does not deserve this kind of ambiguity and eligibility standards. With a big question is whether or not these players will actually get in the game tomorrow. The head coach Lane Kiffin has compared this to new players joining new NFL teams where it could take a couple of weeks to get them ready with. Police later break open the Jeep's window. Prosecutors say she was stabbed to death by her boyfriend Royce Moser. Moser's mother Rachel Moser is accused of helping him cover up the alleged crime. Surveillance video capturing a dramatic crash at a railroad crossing in Poland. A truck getting stuck on the tracks after the crossing gates came down. The driver, you see it right there, then trying to pull forward when the train smashes into its side. A second angle shows the collision and the train and a cloud of debris no injuries reported the incident is under investigation. 21:42Although employees were able to see it. No one else could be there because it was behind security gates. The remarkable feat thanks to more than 100 volunteers. Representing some two dozen organizations using heavy equipment and specialized trucks to transfer the statue seven miles to a public park. We have five latter artists set up. We have a police motorcycle group here. We're really doing a dignified transfer of the monument. I know we did our part. I'm Wilkes Wuggler, 405, Philadelphia. We're a retired apprentice coordinator. Came out here to volunteer our time. Most of these guys are still working. But we come back in 50 years. And it's still me there. God willing. The effort full of heart and determination to make sure this monument to the lives lost on 9-11 is accessible to the entire region. I can't believe it's been 25 years. One of my best friends lived in New York at the time. We went out there to be with her.

22:43I got to see all the missing signs. That kind of will be forever imprinted in my head. Everybody in the country, one way or the other, knows somebody that knew somebody that died on 9-11.
