And when all was said and done, that's exactly what's going to happen. Because Judge Graff decided that there was more than enough evidence to bind Tyler Robinson over for trial. And not only that, he didn't get rid of the aggravated enhancement that could have gotten rid of the death penalty for Tyler Robinson. So not only is Tyler Robinson facing murder charges, he's facing the death penalty. Judge 20 Graph decided in favor of prosecutors, who said they have enough evidence against Tyler Robinson to put the 23 year old on trial on a charge of aggravated murder, which could see him face the death penalty life in prison without parole or 25 years to life in prison with parole. So I highly doubt it'll be 25 years to life in prison with parole. It's either going to be the death penalty or life in prison. And I think that if the evidence keeps coming in the way it is, it's going to be rough for Tyler Robinson to not end up meeting the hangman's news. And if he's guilty of all of this, I think he should. Society has to pass a message here that shit like this is not okay. And I don't give a fly and fuck what your politics are. Nobody should be getting killed on live TV or

2:05anywhere else because they have a political view that leans one way or the other. But for the court and provo Utah went to recess earlier Tuesday, Graph said he needed time to go over the 24 pages of notes that he took during the closing arguments of Robinson's pre-lim hearing. Well, I can't blame him. Lock going on, right? And you want to be thorough, especially as a judge. And so far, so good when it comes to judge graph. Prosecutors presented much of the evidence against Robinson during a five day hearing back in July. A factor for the aggravated murder charge is a reasonable belief that the defendant knowingly endangered others in Kirk's death. The state of Utah argued Robinson targeted Kirk because of his political beliefs. And knowing that children were present and would witness the shooting. And I find that the defense is argument here a bit laughable. The guy sitting up on top of a building allegedly and fires a bullet at somebody. How can you say with a straight face

3:07that nobody else was in danger? Sure, it seems to me that everybody that was in the path was in danger. So I'm not shocked to see the judge keep the aggravated enhancement attached to the charges. And I think it's the right way to go. The judge said his decision was based on the documented position of several individuals in and around the canopy area where Kirk was speaking among other factors. These circumstances support a reasonable inference that defendant was aware that other individuals were positioned near Mr. Kirk when he fired graph said. And I think that is legitimate. Are we going to pretend that nobody else could have been injured? Like for real? Remember it's not that somebody was injured. It's the risk of people being injured. And that's why the judge decided to go with the prosecution when it comes to that enhancement. And I thought that would be the case. I think the prosecution has done a good job making the argument. Now does that mean they have all

4:10the evidence they're going to need to get this over the finish line? I don't know. I haven't seen all the evidence yet. But as of now, certainly enough to go to trial. And there's certainly an overwhelming amount of evidence to get it over that hump. Not that there's an overwhelming amount of evidence that's been produced. That makes Tyler Robinson guilty at this point. But certainly enough evidence to have it go to trial. And that's what this whole prelim hearing was about. Wasn't the real argument? It was the appetizer. Today's decision, which comes nearly a year since Charlie was taken from us, marks an important step in our family's pursuit of justice for him. Kirk's family said in a Tuesday in an email statement, every step in the process carries the weight of all that Charlie's murder has taken from his family, especially as children who will grow up without their father. We're grateful to all those who continue to pray for us, support us, and stand with us through a year of unimaginable grief. And the fact that people like pile on this

5:14woman is bizarre to me. Like, I don't care about Erica Kirk one way or the other, and I wasn't a big fan of Charlie Kirk. I didn't dislike him. I just didn't care one way or the other. But I think it's reprehensible, honestly, the way some people have carried on. And the fact they're profiting from it is crazy. And you know the sad truth? A lot of the people out here that have all of a sudden inserted themselves in the conversation, inserted themselves in the debate, weren't even fans of Charlie Kirk. And I have a suspicion that a lot of these people are chaos agents. They're not looking for justice. They don't care what really happened. They want to cause as much chaos. And so as many seeds of pain as possible. And there's always going to be an audience for that kind of shit. Always. Because the truth is when it comes to the media, you're not selling papers on happy stories, right? If it bleeds, it leads. As the next phase of the judicial process begins, our family remains united in our love for Charlie,

6:17our commitment to the pursuit of justice, and our prayer for a transparent and timely process. The statement said, on Tuesday, prosecutors said Robinson shot and killed Charlie Kirk, because he disagreed with him, and he did it by firing a high-powered rifle into a crowd of thousands. They added that there is a mountain of evidence against Robinson, and it's overwhelming. Look, I agree. So far, not looking good. And if you go and look at my track record, talking about these kinds of cases, I've pretty much called them all spot on. And that's because I read the core documents, right? And if you're seeing the arguments develop in the background on the docket, you know what to expect. And when it comes to Tyler Robinson, the circumstantial evidence is as high as Mount Everest. Now, again, just to be clear, that doesn't mean that they're going to have enough when all said and done. And when Robinson's team begins challenging what they've shown us, because at this stage, this has mainly been one way traffic, right? And what I mean by that is we've only really heard from the prosecution.

7:22And that's because that's how this process works. But now that he's been binded over, I expect this team to start challenging this shit, section by section, evidence by evidence, and we'll see what they come up with. But as of now, not looking good. For Mr. Furry. The defense's closing argument mainly focused on the enhancements to the charges that would allow the prosecution to seek the death penalty against Robinson. The attorneys argued that the aggravating factor needed for a capital case in which other lives were knowingly put at great risk hasn't been proven. Because the shooter had a clear shot and only fired once over the crowd. Well, I think the law states that if other people are in danger of being harmed, then that aggravator certainly kicks in. And I don't think there's any debate here. If you're firing over a group of people, thousands of them, shit can go south real quick. To counter that argument, prosecutors said you can't shoot a rifle into a crowd of 3,000 people and not know that you're

8:25posing a significant risk of death. And I think that's very logical, right? I mean, when you look at it from a neutral perspective, and that's certainly what I'm doing, I don't have any problem with the aggravator. Robinson had no visible reaction to the arguments. His mother Amber Robinson watched from the courtroom gallery as his father Matt listened with his head bowed. Kirk's parents, Robert and Catherine Kirk, entered the heavily secured facility, Armin Arm, before the hearing had the fourth judicial district, Courthouse and Provo. Erika Kirk would have seated beside them. The family stepped out during part of the prosecutor's argument that described the shooting. Yo, I don't blame them. Imagine living with that shit every day, seeing it all the time. All these people talking out of the side of their neck has to be horrible. Think about how you feel when somebody passes away, even when it's from natural causes. Imagine if some fucking Yahoo on the internet started popping off about your mom or your dad or your husband,

9:28shit's monstrous, and the people engaging in it, they should check themselves, but they won't, because it's all about the engagement, right? It's all about being part of the team. Robinson is also accused of obstruction of justice, which carries a penalty of up to 15 years in jail and felony discharge of a firearm, causing serious bodily injury, which carries a penalty of five years to life in prison, according to the Utah County Attorney's Office. Graph ordered Robinson to stand trial on all seven counts. So look, this battle has just begun, and it's going to be a very, very long process. How long it takes? I'm not sure. That's going to depend on how much discovery has to come in and how much time it's going to require to go through all of it. So buckle up. Unless Tyler Robinson decides to plead guilty at some point and get some plan to deal, this is going to be a long ride. And when I say a long ride, I don't mean months.
