Joe Dillon: Why Mediation Beats Court, Even in High-Conflict Divorce

Joe Dillon puts the odds of mediation working at 90 to 95 percent, even when the two people are furious with each other. Only about 2 percent of divorces, he says, truly need a judge. Most of the rest are couples who are angrier than they are actually far apart.

Joe Dillon is a divorce mediator and the founder of Equitable Mediation Services. He came to the work from an unusual direction, with an MBA in finance and negotiation and about thirty years of studying how agreements get made, and he mediates entirely online across several states. He also grew up inside the opposite approach: his parents litigated a divorce so bitter that his father had to be restrained in the courtroom while Joe watched from the back.

In this conversation, Joe and Lisa work through what he does differently with a high-conflict couple. He explains options creation, where each person goes away, ranks their choices, and comes back to find they were in agreement all along, and the phrase he uses for couples who are screaming past their own consensus: violent agreement. He describes his role as part guide, part referee, part cheerleader, why he keeps sessions to two hours, and why five to eight of them beat years of waiting on a court's calendar.
