The Bali Villa Shooting: Convicted Murderers Face Appeal

0:00Hello and welcome to the trial Australia, I'm Wayne Flour. Today we're talking about a horrific shooting which occurred in a luxury barlie villa last year which killed one man and injured another. Three Australian men, Mevlut, Cuskin, Payout, Middlemore to Power and Darcy Jensen were convicted and sentenced to prison. However, Indonesian prosecutors have now appealed the sentence, seeking a tougher punishment which could include the death penalty. Zivane Radmanovik, who was killed in the attack, was a father from Melbourne, but investigators later revealed they believed that the shooting may have been a case of mistaken identity with the gunman allegedly attending to target someone else.

1:00Now during the trial, the three men claimed that they had in fact been hired by another Australian to travel to Bali and frighten their actual target in a repainting a death. The man that hired them was referred to as Mr X. However, the three men refused to reveal his identity out of fear for their family safety. I'm going to be breaking down everything we know about this attack and trial with friend of the podcast Paul Shapiro, including what happens now that Indonesian prosecutors are seeking a tougher sentence. 4:15Welcome back to the trail Australia. I'm here with the Daily Mail reporter Paul Shapiro. Now, Paul, you and I have both had a little bit to do with this job. It's unusual in that, I mean, that they're obviously, that there are Australians and Melbourneians involved in this, but the trial itself has taken place across the oceans in Indonesia and Bali. So Paul, you've been dealing a fair bit with it more than I have. Let's just sort of go all the way back to the beginning and set the scene. So where does it all take place and what do we know about the victims? There was a suspected gangland shooting just after midnight on June 14 in Bali in this nice, ideally area of Munga and basically some masked men storm the villa where Melbourne underwater figure, San Agama was staying with his partner Danny Elgotea. Also there was his mate, Zivane Stipe, Rad Manavik and Rad Manavik's partner, Jasmine

5:16Goddeer, who's Daniel's sister, the government stormed in. They shot gammon six times, they beat him up and then they beat up Rad Manavik and they shot him three times and he died of his gun wound injuries. Yeah, it was some nasty stuff there, Paul. Now, what can you tell us about the targets? I think one of them, actually, the gentleman who was killed may not have been the actual target. What can you tell us about these two, Paul? Well, he's now 34, he's known in Underworld Circles in Melbourne, he's actually the former partner of Slane Melbourne drug lord Carl Williams, his stepdaughter, Daniel Stevens. And yeah, he did some jail time back in 2014 for a non-fatal shooting in Broadmato. So, you know, he's in amongst it. He came out that he was the primary target and actually the government got Rad Manavik mixed up. Now, Rad Manavik, he's virtually a clean skinny over here. I think he's had some court appearances. There was an image of him on social media wearing an ankle bracelet.

6:17You'd only wear one of those if there was some serious criminal allegations against you. But other than that, not too much to learn about him in Melbourne's Underworld, I think gammon was probably had a bit of a higher profile. Yeah, now, do we know, Paul, why they were over there in Bali? Why were they staying at that villa, these two, and who else were they there with? So the pair were there with their partners. So Daniela Godais was Ganem's partner and her sister Jasmine was going out with us. We've Rad Manavik and I understand our over there to celebrate Jasmine's 30th birthday. Ganem and Daniela had been there a few weeks, maybe longer, but Rad Manavik and his partner only arrived two days before he was shot dead. Now, on the night of the attack, who were these perpetrators, how did they get in and what did they do once they did get in? We've since learned high assassins, Milavik, Koshka and Payale, Metapool, Topoa, used a sledgehammer. They smashed their way into the Villa Casa Santiasa, which is where the couples were staying.

7:23They wore helmets, masks, and they went in and they clipped Rad Manavik, shot in three times, and then they beat up Ganem as well. I think it came out later that the reason they were there was they wanted to intimidate Ganem into paying some sort of debt. It's really unclear. The explanation does really seem to make a whole lot of sense. At the same time, while those perpetrators, there was a third Australian Darcy Jensen, a 24-year-old. Now, he was the one who was said to be basically their handler. He was arranging things for them, handling, as they say, logistics. He was the one organising transport for the pair. Apparently, he was there a few weeks before the shooting. He was also casing out the target. Yeah, and they were all dressed in sort of high vis-gear and just stormed in. It was crazy stuff that went on inside that Villa, and another interesting thing about it too. You touched on about the motive for it, about a debt, and things are very unclear about

8:24this debt, and why, if you needed to intimidate a bloke over a debt, why would you do it in Bali? Interesting question. Why, indeed, why not do it in Melbourne where these people are from? The intended target, Ganem, he'd been in Bali for a fair while. Maybe he was hiding out there, possibly, but the night that had happened, it was absolutely crazy. I mean, this is a part of Indonesia and Bali, which is well known to Australians. It's a place that many Australians like to visit. And if there was loud gunshots ringing out in the middle of the night, it was blood. There was people everywhere. It was a pretty chaotic scene from all reports. And I think it was Coscan and Tupua, the shooters. They'd previously alleged that the death was not intentional, and it only occurred during the chaos of the night. Yeah, we'll get into that into what was said at the trial in a bit there, Paul. But it's interesting, too, you know, I mentioned earlier that we've both done stories on this. And we know that here in Melbourne, and it is unclear

9:26why that supposed hit took place in Bali. But we do know that they were being targeted over here in Melbourne, too. I mean, I went out to the property in the Western suburbs here, and the surviving wife had fled that house very, very quickly. And then I think it was Danielle in up in the more the leafy end of Melbourne. Her boutique beauty beautician place had been destroyed by fire. They'd been bombed in a house that they owned it, but they weren't even living in the house. And their renters got firebombed. There was links straight away to other things that have happened in Melbourne. You know, Danielle was linked on social media to the assassinated Melbourne gangsta, Sam and the Punisher Abdelruim. And we both know where that kind of investigation and suspect to the heading, wherever that's linked or not, who knows. But it just seems to be happening all the time now in an Australian Melbourne. Just going back to the kind of like the motive in court, these guys have said they're running on the orders of a mysterious Australian overlord who

10:28ordered the job, and he's only been known as Mr X. And it just reminds of the last time I was on this show, when we were talking about that alleged kidnapping and murder and grandfather of Chris Bugs Aaron, and it just seems like here we have another mysterious Mr X, that no one seems to want to name in court. And just going back to what you said, Wayne, you know, Danielle and Dan and fleeing their homes and flying under the radar. I mean, obviously if he was the target of this hit, you know, he's clearly probably still in danger. It's of some I understand that he didn't want to go back to Bali to give evidence in person. He gave evidence, orally. Well, that's right. Now, Paul, just again, on these three attackers, they were picked up pretty quickly, weren't they? I mean, it was quite extraordinary. And they did a very good job, the the violinese police in getting them. How did they escape on the night and where were they caught? They escaped on vehicle, they dumped weapons. For about 24 to 48 hours, there was rumours swelling at everywhere. Is this some international kill team, wherever they could be anywhere? But actually, Indonesian authorities were very quick to get them. The first one they got

11:34was Jensen. So he was detained and interrogated by border officials on the Monday, which was just probably just less than 48 hours after the murder. He was trying to border flight at a Jakarta airport, but a light blinked up and it showed authorities that he was on a immigration blacklist, and he was trying to leave the country for Cambodia. He was flying through Singapore. So they got him. And in the next day, they got Coscan and Tupua in Singapore and Cambodia, respectively. And that was just the day after Jensen was arrested also. They thought they were scot-free. They got all the way out of the country and bang. They picked them up at the airport. Yeah, they left the favorite of evidence behind, I think. CCTV camera, you know, they found the guns. They found the hives. Now, once they got back here, things unlikely in Australia, which were our listeners have all heard that the wheels of justice in this country move extremely slowly in Indonesia. Things moved very quickly, didn't it? And these people were on trial before you knew it. Yeah, I mean, we've sat through a couple of recent core cases,

12:39which met the trials in Victoria. They've soon been going on for years. These guys were arrested in June and their trial commenced in October. It's now March, they've been sentenced. So, I mean, it's not even been nine months and it's pretty much over. Yeah. And I mean, here in Australia, we know a little bit about the way the courts are. We've, of course, we've had some pretty famous drug mules go through Bali, the Bali nine. We've had Chappelle Corby. And it's a very open sort of court isn't it in regards to a lot of the, they've got cameras and things. So, we're able to sort of keep watch of what's going on. So, what can you tell us about this trial and the charges that they faced? Well, on the arrest, the Bali three, as they've actually never been turned like your Bali nine, I guess, they were all charged with pre-meditated murder. So, that's a charge in Indonesia that carries the maximum death penalty. The three confess their crimes. But then, and then now it's trying to play down their kind of role in what the actual

13:39murder was. And I think at one stage, I was trying to have, I definitely think it was possibly lawyers for Koskinen to pull. We're trying to get the charge down greater from murder to assault. It wasn't really a trial of whoever they were guilty of. And so, it was more of a trial of like, how much time they would do behind bars, you know, say they raised a lot about their character and how the couple of them are young men. And they still had time to, you know, rehabilitate. And the families of the victims also had their opportunities to go over there. And I know Jasmine's on the record. She was, she wanted the death penalty. Cascon didn't speak at the trial, but to poor did read out a apology letter to Red Manavik's family. He said, I'd like to take this moment to silly apologise to your family for this suffering, of course, and for loss of your beloved Ziver. And obviously, yeah, as we said, Gavin or Daniela turned up out of safety fears, but he did provide written evidence. So their partners in the end, I know when I was out there, they were not cooperating with the trial because they were terrified that, you know, they were going to get whacked. In the end,

14:41did they not give any evidence at all? Yeah, they gave written evidence to the Indonesia court. That's my understanding, but not in person. Do you know how long the trial actually went on for Paul? Well, it started in October and it was sentencing on, I think, much 14. So as far as sitting days, I can't tell you, but it wouldn't have been very long. There was some delays. The sentencing was supposed to happen a week earlier. Everyone had gone over there for it. It's not like us here in Melbourne where we've got to go in the city, possibly get a train. It's like, oh, well, we've got to come back another week. People made flights. But yeah, once again, it was a pretty streamlined. It didn't go very long. The other key thing that happened was during the trial was Jensen also gave an apology

16:45to Ray Manovick's partner. I was in December, I believe. That was before two powers apology in February. So at the end of this streamlined kind of trial hall, ultimately, what was the conclusion and what was their sentence? So the presiding judge, Wayne Suata, he ruled Coscan, Topoa and Jensen were legally and convincingly guilty of premeditated murder. But the sentence was a bit lower than prosecutors and I guess the family expected. So all three were sentenced on March 10. Jensen, he was dealt with separately. He was sentenced to 12 years for his role. And Coscan and Topoa who dealt together, they were given 16 at a pace. Right. And what was the family's reaction after these sentences were handed down? Did they come out and say much at all? So Jasmine and mother of six, you know, her and her family were at court for the sentencing. You know, her mother, Renata Deegan, she was at court also. Outside, she slammed the sentences. She said it was a joke.

17:49She says it was a joke that the group are allowed to just walk away. It's also been reported that another angry family member yelled out to Jensen and I quote, you happy that you dog, you effing dog. And that was as he was led from densified district court in handcuffs to the notorious Carabocan prison. Yeah, it's certainly not a place he'd want to spend any anytime. That's for sure. Now the presiding judge, he obviously took a lot of things in in a account coming to that decision. What did he say to some of the things that were mitigating factors that that helped him come to that sentence? Well, the panel of three judges said the defendants had caused deep trauma to the families, the two victims, the presiding judge. He noted that the defendants had no pro criminal records and had been corrupted throughout the investigation and trial. They're still young and have the chance to improve themselves in the future. And he also stressed the punishment. He's not intended as a preventive measure. So similar acts do

18:56not occur again. Paul, it's kind of understandable that the family were not too happy with the sentence. I mean, when you think about it, someone like Chappelle Corby, she did nine and a bit years herself for having a bit of marijuana in a boogie board, which you know, it's largely legal in in Australia now. And these guys aren't looking at a whole much longer period behind bars. Has there been talk over there about a potential appeal? Yeah, there has been talk on appeal and apparently the appeal has been lodged already. So prosecution weren't happy with the sentence handed down. Do we know how far the prosecution want to go in regards to this appeal? Are they talking about more time behind bars or are they pushing for the firing squad? I'm not at this stage. They haven't previously. Like I said earlier, they made demands. And now the gents and was four years under white prosecutors asked to call the sentence and two behind bars. And the other two

19:58were two years below the sentences that the prosecution asked. So I can only expect that, you know, it'll be more time in jail. But who knows? I judge the turner. I go, yeah, hang on a second. Yeah, these guys should be facing the firing squad because, you know, as you know, down here if you appeal a sentence, there's every chance you might get more time behind bars. And I think it's the same over there. The prosecutors said this in regards to appeal. In the case of the three defendants, the public prosecutor considers that the decision has not yet fulfilled the sense of justice into society, especially for the two victims, Rad Manavik and Ganem, who they noted was seriously injured following the attack. Is there any word, Paul, of when that appeal might take place? Not at this stage, but judging by the way that they burned through their murder cases, like it should be pretty imminent. All we know now is that there's an appeal and it'll be heard in an international call of appeal over there. All right, Paul, thanks for running us all through

21:00that. It's an intriguing case. And as we've all heard, it may not be quite over yet. So that appeal is going to be very interesting. And like I said, they could get a bigger whack and it's risky business running an appeal when you can potentially face the death penalty. But, Paul, thanks again for coming on the trial Australia.
