2:04And not a good one as it relates to the midterms. The message that they may be sending is that they are not going to allow about eight or nine Southern states to redraw their maps to eliminate black representation. Steel 19 or 20 seats off the Congressional map, put it in the magick column before the midterm election is even run because we've been waiting since October the 15th on a decision about the Voting Rights Act. Coming out of a case in Louisiana called Kalei. Now if the United States Supreme Court and the MAGA 6 were able to issue that ruling, gutting the Voting Rights Act, gutting the language that says that no law that abridges the right to vote shall stand if they'd been able to do that in October with a quick order or November, maybe even December, then legislatures around the deep South in places

3:07like Louisiana and Georgia and Alabama would have been able to get their legislators back together again, redraw the maps and eliminate black representation in the South and give Donald Trump a 20 point advantage or more before the midterms were even run. But the next time the Supreme Court issues its next set of rulings is at the end of March and under a doctrine called the Purcell doctrine and based on a ruling that just came out last week by the United States Supreme Court about New York maps, I do not believe that they are going to be issuing this order quick enough so that 20 seats go into the Trump column come the midterms. That's either because the MAGA 6 don't want to give Donald Trump that win, especially after he's been bashing them after the tariff ruling or a combination of that and the three liberal moderates on the Supreme Court, slowing down the process by writing elaborate

4:11descents that take a lot of time. They're not ready yet and therefore the decision will not drop. But March is a red letter month, if you will, for Donald Trump, because if it doesn't come in March, then we're going to be playing it under the old rules and the seats are not going to be advantage Trump, Michael Popak, you're on legal AF on Monday, let's talk about maps. They're important. Every two years, 435 members of Congress run for their lives and run to be reelected the entire House chamber. Donald Trump has been working with Republican state legislatures because they're in charge of that process to redraw maps to try to gain an electoral advantage. He's trying to steal your vote. He's trying to steal your local Congressperson seat. He's trying to get all of that advantage before what is shaping up to be a losing political

5:13suicide of a midterm for Donald Trump based on the rejection of his policies here and his war policies are brought. So states like North Carolina and Georgia and Alabama and Louisiana and Tennessee and Mississippi and North Carolina and South Carolina, we're ready, ready to try to redraw maps if they got the Kalei Louisiana decision in time. That was argued on the 15th of October. If MAGA had the ability on the Supreme Court to influence the midterms, they would have powered through the decision. They would have issued it at the end of October and or beginning of November and maps could have been withdrawn. But we're in March. This is when the first of major decisions come out. Let me remind you of the calendar for the United States Supreme Court. First Monday in October, it opens that term. There's the fall term and the spring term that makes up the complete term of the Supreme

6:14Court. It goes from the first Monday of October until the last opinion is dropped at the end of June, middle to the end of June, then they go out on summer vacation. Now, emergency dockets are not part of this calendaring process because even though they're on vacation, they can rule and have ruled on emergency applications on the shadow docket brought by the Trump administration throughout the first year of the administration. We'll have to see what happens the second summer. The last oral argument because each appellate case consists of traditionally a three briefs, the opening brief by the person bringing the appeal, the opposition brief, and then the reply brief. There are other briefs that are submitted by friends of the court about a particular issue. Then there's oral argument scheduled for half an hour or an hour often goes longer. And then they go into the let's figure out how we're going to vote. Do we have five votes for a certain position and who's going to write that decision all administered

7:18by the Chief Justice Chief Justice Roberts? The last oral argument will be an April traditionally gives them time to issue the rulings in June. Now they're wearing March, we're running up against another court imposed roadblock. It's called the Purcell doctrine. It's artificial. It's made up by the Supreme Court. They often violate it. But generally, it is the principle that they are not going to interfere with state election law, state map making of congressional federal congressional maps or anything as we get closer to an election. And this ship for me has already sailed and for many observers. I mean, primaries have already happened. On the third of March, we had North Carolina and Texas primaries. On the 10th of March, we've got other primaries. In April, ballots start getting mailed out from mail-in ballots in Georgia, Alabama, and Louisiana. Louisiana has effectively thrown in the towel. They were ready to hold the special session to redo the maps in October or November, but

8:20when they saw the Supreme Court not ruling, they said, all right, we're going to go with the old maps. Now my interpretation is that when last week, the Supreme Court issued a ruling that blocked new maps made by New York, because the Supreme Court, at least six of them, found them to be racially motivated, not they're okay if you redraw the maps in order to enhance Republican or Democratic power. They're not okay if it's blatantly racial, like black and red and blue were fine, black and brown aren't. That's the way I remember it. So what the Southern states would have done if they could have done it is they would have packed all the black and brown people into one district, right? It's called pack and then crack. You crack the power, you know, you crack, you crack the power in half or more of the minority

You stick them all in one district so they only get one representative, even if they're a third of the state, you shove off one third into one district so they don't get the power that would come pro rata from seats representing their political power. The New York case in which Alito set out loud, this is racial gerrymandering. We had a step in, yes, it violated the Purcell doctrine, but I interpret it now a different way. It's basically saying that we are, we don't want new maps, this late in the game, especially if they're racially motivated. If you look for the silver lining in that decision, then now that the calendar has turned to March, it is a terrible sign for Donald Trump. He's going to have to win this election fair and square, right? Challenges to his mail-in ballot, executive order, challenges to the voter ID law in court,

10:22which are going to tie up through the midterms. The Supreme Court see me to be unable or unwilling to give Donald Trump a win when it comes to maps, congressional maps, and why is it important to Trump? Because remember, he's not on the ballot, but if he loses the house and he wants to get that 20 point advantage, if he loses the house, he's a dead, he's a dead duck, he's already a lame duck. He'll be a dead duck because he'll have no one to support him. And if we get the house and the Senate, at the same time, the Democrats, then the impeachment process starts, the removal process starts, the oversight hearings in earnest start and and as we move our way into the 2028 election, I mean, this is shaping up to be a wave election for the Democrats, gas prices, curdling towards five, six and seven dollars at the pump because of Donald Trump's bombing and wars, the economy on life support, the zero

11:25job creation, a jobless economy, if you will. These are all things that whenever it's happened in history, the party in power loses and loses big at the midterms. Remember, there's a slim Republican majority in the house. It's only plus five, really, plus four with some special elections. So it's not going to take much. The prediction is that the Democrats could get 225 to 230 seats in the house. They only need 218 to have majority. Now they need six effectively, you know, a 57 58 to 60 seats in the Senate. But who knows, there's so much pent up demand to punish Donald Trump and MAGA. They all can be wiped out. So maps are important and the Supreme Court's role now. One of the things that the moderates of the Supreme Court were upset about in Katanjee Brown, Jackson, so it's a Mallory Gagan is that they saw what the Supreme Court did last

12:27week about the New York maps as a violation of the Purcell doctrine. But I didn't see it that way. It is, it is a violation, but they're ultimately going back to the original maps and they're trying to, they're after that, stay out of the election process. I just don't see them benefiting Donald Trump and allowing the entire game board to be redrawn. This close and after primaries have already started.
