死刑是台灣最大的公民議題之一，台灣對於死刑存廢討論始於 2001 年，
時任中華民國法務部部長陳定南於2001年公開宣誓要推動廢除死刑。
2003 年 總統府公布「人權基本法」草案，
第五條明定「人人享有生命權及生命自由權，死刑應予廢除」。
2005年～2010 年台灣曾長達四年沒有執行過死刑。
2014，鄭捷和 2016 小燈炮等隨機殺人事件，再次掀起死刑存廢討論。
