S15 EP157: Hour 3 - The Law Around the Clancy Trial

1:01I should tell the bosses as well. I'll just do it all publicly. I have applied to be Tiger Woods driver. Not not the one of the golf course, but the one who actually drives him around. He's been banned from driving now for five years. Can't even drive a golf cart. Mr. Woods, as long as you will talk golf with me and not mock my swing, I will drive you wherever you go. I will keep your secrets. I will sign your NDA. I will be your guy. Just saying, you are going to have paid me a lot of money though, because I can't afford too much of a pay hit. But I'm just I will gladly drive you wherever you need to go. We need to talk about Lindsey Clancy. Because boy is the Twitter mom. The Twitter mom is just they got it wrong. Look, I think most of you know, I was a lawyer for a number of years. I did criminal law. I never handled a murder case, but I did criminal law. And there are some nuances to this case that the conversation's happening on your Facebook groups

2:09and your social media groups, they have completely missed and they are deeply relevant to this case. The jury is in its fifth day of deliberations. Lindsey Clancy's lawyer has told the court that she is not mentally capable of being retried. If there is a mistrial, she will be mistried. I want to say a couple of things about this case and you need to understand that they actually do come from a background. It's not just a lawyer, but a someone who served on juries as well. The courts have model charges. Essentially over time, the courts, when they charge the jury, the jury is ready, series of instructions. And over time, the states and commonwealths of the nation, Massachusetts, the commonwealth, not a state. They have written down the model jury instructions so that nobody can get out of line because if

3:16a judge reads a bad instruction, the whole case can be thrown out and you have to redo it. So they do model instructions. Lindsey Clancy pled not guilty based on lack of criminal responsibility. Lack of criminal responsibility is also in most states considered not guilty by reason of insanity. Her defense is that after she strangled her three children, she slid her throat and threw herself out of a window. She didn't slice deep enough and didn't fall far enough and is instead paralyzed for the rest of her life. Did you know that? Did you know Lindsey Clancy after strangling her three children slid her throat through herself out of window? And the defense says that's proof she was not in her right mind. And the judge said, okay, you get to make that case. And Massachusetts of the 50 states, Massachusetts is, I believe it's the only state.

4:21There may be one other, but I think Massachusetts is the only state that you got to follow along with this because you're not getting this when you when you read about it on social media, and you're talking to your friends, you're missing this quirk of Massachusetts law that is so fundamentally key to you understanding why the jury is deadlocked. And I don't think they're going to find a compromise. I think they're going to be a mistrial and redo. I'm with Nancy Grace on this. Here is the thing you have to understand. In 49 of the 50 states, when you plead guilty by reason of insanity, you must prove to the jury you were insane unless you do it in Massachusetts, in Massachusetts, in the Commonwealth of Massachusetts, it is the only state in the nation where if you plead guilty by reason of insanity, the judge says there is enough evidence that judge has a checklist to go through. Say, if they meet these criteria, they can, they can plead guilty by reason of insanity.

5:24And if they do, the prosecution must prove you are sane beyond a reasonable doubt. You don't have to prove you were insane. The prosecution must prove you were sane beyond a reasonable doubt. There can be no doubt, no reasonable doubt in a jurors' mind. This is a woman who strangled to death, her three children, slit her throat and threw herself out a window. Can you prove beyond the reasonable doubt that she was in her right mind? I'm going to read for you the jury instruction. This is what this jury was read by the judge before going to decide the case. The defendant has pled not guilty due to a lack of criminal responsibility. If the Commonwealth has proved the elements of the defense, the crime beyond a reasonable

6:25doubt, the Commonwealth must also prove beyond a reasonable doubt that the defendant was criminally responsible at the time of the alleged defense. Under the law, a person is not guilty. If they lacked criminal responsibility while they committed the offense. This is sometimes referred to as not guilty by reason of insanity. There is no burden on the defendant to prove they lacked criminal responsibility. You got that? This is what the judge told the jury that there is no burden on the defendant to prove they lacked criminal responsibility. The Commonwealth may meet its burden, approving a defendant was criminally responsible for their conduct in either of two ways. The first way is the Commonwealth to prove beyond a reasonable doubt that the defendant did not suffer from a mental disease or defect at the time of the alleged defense. A mental disease or defect need not fit into a formal medical diagnosis. It is a legal term, not a medical term. It does not, however, include an abnormality that presents itself only by repeated criminal

7:29or otherwise anti-social behavior. It is for you to determine from the evidence whether the defendant had a mental disease or defect at the time of the alleged defense. The second way for the Commonwealth to prove a defendant was criminally responsible for their conduct is for the Commonwealth to prove beyond a reasonable doubt that even if the defendant suffered from a mental disease or defect at the time of the alleged defense, the defendant nonetheless retained the substantial capacity to appreciate the wrongfulness or criminality of their conduct and to conform their conduct to the requirements of the law. To establish that the defendant had the substantial capacity to appreciate the wrongfulness or criminality of their conduct, the Commonwealth must prove beyond a reasonable doubt. The defendant appreciated that is the defendant newer understood in some meaningful way that their conduct was either illegal or wrong. To establish that the defendant had the substantial capacity to conform their conduct to the

8:30law's requirements, the Commonwealth must prove beyond a reasonable doubt that any mental disease or defect that may have existed at the time of the alleged defense did not deprive the defendant of their ability to behave as the law requires that is to obey the law to summarize. If the Commonwealth proved beyond a reasonable doubt that the defendant did not have a mental disease or defect at the time of the alleged defense, the Commonwealth has to have satisfied the burden of proving the defendant was criminally responsible alternatively. If the Commonwealth proved beyond a reasonable doubt that even if the defendant did suffer a mental disease or defect at the time of the alleged defense, the defendant nonetheless retained the substantial capacity to appreciate the wrongfulness or criminality of their conduct and to conform their conduct to the law, the Commonwealth has satisfied their burden. Remember that there's no burden on the defendant to prove that they lack criminal responsibility, rather the burden is on the Commonwealth to prove beyond a reasonable doubt both that the defendant committed the crime and that the defendant was criminally responsible at

9:32the time. If you, this is again, this is what the judge read to the jury. These are the judges' words to the jury. If you have a reasonable doubt whether the defendant committed any of the required elements of the alleged defense, you must find the defendant not guilty. If you have a reasonable doubt whether the defendant was criminally responsible at the time of the offense, you must find the defendant not guilty by reason of lack of criminal responsibility. In other words, if you believe the defendant committed the crime and Lindsey Clancy's lawyer said she killed the kids. It wasn't a husband, it wasn't a maid, it wasn't a mistress, it was not a rando, it was her. She killed her kids, that's their defense. And the judge tells the jury, if you believe she is guilty beyond a reasonable doubt, but you have a reasonable doubt whether or not she was in her right mind when she did it, you

10:33must not may, you must find the defendant not guilty by reason of lack of criminal responsibility. In other words, you must find the defendant not guilty by reason of insanity. If you have any doubt at all that she was in her, it wasn't her right mind. This is a woman who killed her three toddlers, slither throughout through herself out of window. The argument by the prosecution is essentially that she was clearly in her right mind and could comply with the law because she tried to kill herself after killing her kids because she knew she broke the law. So clearly she was in her right mind when she killed the kids, not after she killed the kids, but in the act to kill the kids, she was clearly in right mind enough to know once she did it, she needed to off herself. That's essentially what the prosecution's got to do. Now you tell me moms, because there are nine women and three men on the jury, moms. What mother in her right mind? What mother in her right mind would kill her children and then attempt to commit suicide?

11:42The prosecution's argument is that this was not all at one time, that there was space. There was a time lapse and that time lapse proved that she wasn't insane when she did it. By the way, the prosecution changed their argument in the middle of the case essentially. Y'all on Twitter, it is she's guilty of sin and she should get the death penalty. And by the way, I agree with that. She should get the death penalty. She killed her three kids. But the law of Massachusetts says otherwise. And the job of the jury is to uphold the law. And in Massachusetts, if someone has allowed the defense of not guilty by reason of insanity, the prosecution must prove beyond a reasonable doubt that the person was sane. Can you really look yourself in the mirror and say beyond a reasonable doubt, this woman

12:44was perfectly sane and in her right mind when she strangled her three kids, slither throat through herself out the window? Can you really look yourself in the mirror with a straight face and say absolutely, she was totally sane, totally sane, no doubt in my mind. She was fully aware of it, fully at her right faculties, knew the repercussions and she strangled her three kids anyway, slither her own throat. It didn't work. She didn't go deep enough so she threw herself out, second story window, hoping to kill herself since slitting her throat didn't kill herself. And it just wasn't too high. And now she's paralyzed for the rest of her life. That's what this whole case is about. And that's why the jury is five days of struggling. That's not what you're hearing on social media. That's not what you're hearing with your friends on Facebook. That's not your conversation of the local coffee shop, but that's the conversation in the jury room. It's the conversation the jurors are having. It doesn't matter what you think it matters with the jury things. You have seen things in the courtroom.

13:45The jury was dismissed from the courtroom and not allowed to see because of the way the evidence was collected because of the way the judge made rulings. Don't trash the women on the jury. He said, oh my God, we've reached the point where women won't find a woman guilty of murdering her kids. No, that's not the point because under the law of Massachusetts, they have to presume she's not guilty by reason of insanity unless the prosecution meets the burden. The prosecution overcharged the case. The prosecution gave them the options of not guilty, not guilty by reason of insanity, murder one, murder two and manslaughter. My guess is the question is whether it's a different, the argument is over not guilty or not guilty by reason of insanity. Given the facts of the case, I don't know that I wouldn't go with not guilty by reason of insanity. I can't contemplate a person of the right mind, struggling their children, slitting their children through and throwing themselves out of a window to be permanently paralyzed.

14:46The fact that some of you can, you got a better imagination than me, I guess. But that's what's going on in the Lindsey Clancy case and that's why I think this divide between the jury may be irreconcilable and she may have to be tried again. But the conversations online, attacking the female jurors, I just think given that people don't realize there's a quirk in Massachusetts law different from all the other 49 to the United States. The prosecution bears the burden of proving beyond a reasonable doubt that Lindsey Clancy was sane. A woman who killed her three children slither through herself out of second story window, leaving herself permanently paralyzed. The prosecution has to prove that that woman beyond a reasonable doubt was sane when she committed the crime. And I don't know that the prosecution can do that. 16:48This is a Georgia lawyer who called it insisted that the law and Georgia and the law on Massachusetts are the same. Georgia and Massachusetts both use the McNaughton standard. The problem, however, is that the burden of proof is absolutely different. If you want the state, Mr. Lawyer who's calling, you can look at McBride versus Stater. You can look at state versus Weerson in Georgia where it is very clear from those cases that the defense must prove by the preponderance of evidence that they were insane at the time of the crime. In Georgia, the defense, and by the way, in 49 of the 50 states, it is the defendant that must prove they were insane at the time of the crime. In Massachusetts, it is the one state of all the 50 where the state must prove sanity beyond a reasonable doubt. In Georgia, all the defense has to do with show that a preponderance of evidence that basically 51% of the evidence suggests the defendant was insane at the time.

17:49You can have the charges of not guilty, not guilty about reason of insanity or guilty, but mentally ill. Massachusetts is different. If you're calling me as a lawyer from Georgia, I mean, this, you're wrong. And I'm actually right on this. And I know I'm right because, well, I didn't practice law in Massachusetts, but I know the lawyers to call in Massachusetts to fill me in on it. And so I did. Now, I got to move on. 19:54of proof to have some boomer lawyer from Georgia calling and insist I'm wrong. I'm sorry. That is a bridge too far from me. Not only do I know how to research the law and use West law, but I also know the lawyers and Massachusetts practice criminal law to call and talk to. So it just just actually don't think you know what you're talking about when you call the yell at my call screener actually know what you're talking about. You can have an informed opinion instead of just convinced that I must be wrong and you must be right just because I that that that's well I have very few I got a lot of pet peas mostly about driving very few about my radio show. But when you want to call in mouth, ultimately my call screener and you're actually the ignorant one just just just spare me. Now we have to talk about Iran gas prices going back up. Let me go to CNBC right here in real time. No, not VNBC CNBC fingers CNBC. And let's see oil prices. We have oil West Texas crude is up to $91 barrel.

21:00Brit crude. So it most of the world uses $96 as Iran retaliates. The Iranians have opened fire. No prices rose today after the US and Iran traded military strikes any weeks of relative calm. The US military completed a wave of strikes on Tuesday against Iran's Islamic Revolutionary Guard Corps. The strikes targeted air defense sites radar systems maritime assets, mind laying capabilities and communication sites. The IRGC targeted US military positions in Jordan, Kuwait, Bahrain, Iraq and the United Air Bimberts fighting has broken out between the US and Iran for the first time since July. More than 70 million barrels of oil transit and hormones on Monday a record since the war began. 20 million barrels accrued were moving through hormones before the war. Gas prices have gone up due to the instability. I played you a tray yeeks earlier.

22:01And this is Scott Beset to the Treasury Secretary on Fox News. And that's exactly what we're saying. We are saying after 47 years this terrible game that they've been playing with the Iranian people terrorizing the Gulf and attacking American citizens attacking the world that the Iranian regime is over as they know it. And they are either going to have to come to the table and be ready to negotiate that they cannot have a nuclear weapon that they have to give up their highly enriched uranium that they have to stop with their terrorist proxies that they have to stop terrorizing their neighbors or this will continue. And I believe that between the kinetic action that our great military did for six weeks, the blockade and the greatest, the effort at financial isolation in the history of the world, history of the world, we are going to grind them into the ground.

24:03But for a while, it doesn't know what's dead. The head still plays us, you're buried ahead and that's what we are doing to disfrogine. We are going to isolate them economically and they will have no choice. They have gas lines, they have 100% inflation, their currency is collapsed. The president of the country, the speaker of the parliament, the head of the central bank is already warning the Iranian people and their military leaders. They are sending out messages that they are in economic trouble. They are in economic trouble, by the way, that there is no doubt Iran is an economic trouble. One of the issues in dealing with Iran is so much of the Western press is so hostile to this administration that you're hearing a lot of things in the American press that is shaped by antagonists to this administration that are not necessarily true. Just consider the G20. Their meeting in the national North Carolina, there is some angst among the G20 leaders

25:05that, for example, Russia was invited to the meeting. There is angst over the US and growth. A European leader is very frustrated with tariffs and the president's constant changing of minds and playing back and forth and flirting now with changing our position of the Falkland Islands with our longtime ally, Great Britain, and they have vented to Scott Besan, but they trust Besan. And you got to understand that a lot of people dislike Scott Besan in the media because of his competence. There is this idea for some reason that we should only allow incompetent people around Donald Trump and they'll expose themselves. I am of the position that I think the most competent people we can find should be around the president and advise him as best they can because he is the president of the United States. We should be able to succeed regardless of who is president. We should want the best people around him. We should ostracize them. But Scott Besan, who is one of the best secretaries of treasury and one of the best cabinet secretaries of this administration, has had a very good conference.

26:06He is going to be succeeded down there at the G20 by Howard Lutnik. They've kind of divided this and here's the thing. The world leaders don't like Lutnik. He's a bully. He's also terrible on tariffs. He and Scott Besan don't like each other. Howard Lutnik is just a jerk. I am not a fan of Lutnik. I think his advice to the president has been terrible. He's scuttled a deal with Canada and sparked a trade war that could cost us Maine and Michigan in the November elections. He's just not a not a great guy in the administration. He and Besan don't like each other. What I find interesting is how so much of the media is more favorable towards Lutnik in their coverage of the G20 even though Lutnik himself is less liked by the members of the G20. And I think that has everything to do with trying to sabotage Scott Besan who has the ear of the president and the trust of Wall Street and world leaders. And Besan's trust that he maintains with these world leaders is key to getting our Western allies

27:09who are really unhappy with the Trump administration right now to go along with us and the pressure on Iran to keep the straight and foremost open. There is a very big effort underway to try to undermine our strength and resolve by getting our European allies away from us. But thus far it hasn't worked. Has it worked? The administration and our European allies are recognizing we have a problem with the Russians. The Iranians leadership and Vladimir Putin have now been seen together. And Vladimir Putin has congratulated the Iranians on their war with the United States and promised them help. There are now reports that the Russians are trying to help the Iranians build hypersonic missiles to target our ships

28:14in the Persian Gulf. There are now reports that the Russians are mobilizing additional assets to help the Iranians fight us and that they are targeting the United States military installations in the Middle East. One of the things you guys may not realize because if you're only watching conservative media outlets that hasn't been covered much, but the Iranians did far more damage to the fifth-leets headquarters in Bahrain than we originally knew. So much so that a lot of our ships are having to sail to Diego Garcia thousands of miles away to get resupplied and then turn around and go back to the Persian Gulf. Diego Garcia is an island at all south of India. It is a great distance from the Persian Gulf. Maybe not thousands of miles from the entrance to the straight-of-form moose.

29:17And we're having to sail down there in order to get our ships resupplied. And that puts a great deal of distance between the United States and the Middle East because of the damage done to Bahrain, damage that was not reported. Listen, I think we just need to go in and just level these people. If you read the report over the weekend and again, I told you guys on Monday morning when I got in here that a source inside the White House texted me. Source inside the White House. Send me that link to the Washington Post story and said, I know you're going to talk about this on your show. And before you attack the military as sources, you need to remember that almost all

30:20these leaks come from civilians in the administration. That's from inside the White House. I was told that don't attack the military for leaking. Then we have Dan Driscoll, we know, showed up at the White House on Monday told the president that Pete Hexeth had fired way more generals than admirals. And the president knew it was far worse than he knew. And the morale is bad and he was resigning. We have problems with his billion leadership. And you know, one of the biggest problems is that there are so many people who are so loyal to the president that they can't actually take any of the necessary criticisms that are needed to move the needle because they just they go into circle the wagons mode. Democrats are Republicans both do it. I find it very annoying that, you know, not everybody is lying. Not every story is a hit job. Some stories are released because they're trying to capture the attention of others who might otherwise be shielded from the information. That was big during Bush's administration too, where people would leak because they knew he was

31:21being protected from certain information, but that he read the newspaper. And so if you saw it on the paper, he would know it's true. Same thing happened with Obama. Same thing happened in the first Trump term. Sometimes the stories are not actually intended to be hit jobs. Sometimes the stories are intended to raise alarms that need to be raised. And the alarm is this. The United States of America has an exhausted fleet of ships and an exhausted group of sailors who are getting really worn out. And we have the ability to fight and we have the ability to wipe out the Iranians, but it must be swiftly done so our guys can get some rest. And if we refuse to allow our soldiers, sailors and airmen to do the job that needs to be done swiftly and then get out, we are going to

32:22put ourselves in an unfortunate and dangerous situation. It's just time to deal with Iran. Stop humoring the Iranians. It's kind of time to wipe them out folks. It's kind of time to get in there and finish this. We should not be continuing to talk about the situation with Iran in the run up to the midterms. We should be willing now to go in and take them out. Open the straight, get oil prices down and do it quickly. You know, we got three days for Labor Day. Why don't we see we can convince the president to go in and there wipe them out quickly, allow Israel off the chains. You know, Israel has been taking out Hamas agents in broad daylight. They have taken out another couple of key leaders of Hamas and broad daylight in Gaza. They've taken out another couple of his blah leaders. Let's let Israel. Let's let Israel do the ground game while we do the air support

33:24and go on and finish the job. Finish the job in Iran so we can get on to the midterms, Mr. President. You know you want to do it. You know you want to and your, your, your generals are telling you, we can't drag this thing out. Get it done quick. So let's get it done quick, Mr. President. Then go stand in a hot shower and relax. You've done your job and maybe at the White House, they have a run eye, take a swatter here like I do. So the president never runs out of hot water.
