RCMP sergeant on sleeping Tesla driver ticketed by police

For the second time in just a week, we're learning about a driver caught by police, slump behind the wheel of a moving Tesla in Metro Vancouver, the second incident of the most recent one was last Thursday morning in the suburb of Langley. Here's some body cam footage released by Hyra Patrol. They say an officer had to divert away from a priority call to deal with this.

2:05A man apparently asleep at the wheel of his Tesla. The driver, though, contests that. Says that he was not asleep here. Last month, a woman in North Vancouver was also fined after video showed her also inattentive behind the wheel of a moving Tesla. OK, let's bring in Sergeant Michael Glockland. He's with our CMP's Hyra Patrol in British Columbia, also a media relations officer, and he's in Surrey, BC. Thank you very much for joining us. What can he tell us about the latest incident? In this latest incident, we did have an officer who was on his way to something completely unrelated. But he can't just pass up when somebody is completely unconscious or so it appears behind the wheel of a vehicle. It is illegal in BC to not be completely focused aware and attentive behind the wheel of your vehicle, no matter your faith in the technology. So he was issued a ticket for $368 that's

3:06driving without due care and attention. Do you know anything more about how that, sorry, interception, whatever you want to call it, and did so the officer sees the person behind the car apparently sleeping, though I hear that the driver says he wasn't sleeping in any event. Do you wait until that car stops? How did the RCMP officer manage to deal with this? So I don't know about this incident in particular, but we do have a rather loud sirens and loud hailers that we can use in these circumstances. So that's typically what we're going to do to pull over somebody who isn't paying attention. It's a very similar strategy actually to somebody who is distracted with their cell phone or loud music, et cetera. What kind of message do you want drivers to get from, I mean, the RCMP made a point in these last two cases to being very public about what happened and the tickets that were issued? So there's certainly some people who know the law and are ignoring it. But what we're really trying to do here

4:07is educate the public, let everybody know this is illegal. No matter your feelings about the technology, the law is clear. You do have to be fully aware, fully attentive, and in control. So that publication piece is really important. And understanding that police are going to issue financial consequences if you choose to disobey that law. So depending on your perspective, and I mean, if you own a Tesla, the financial consequences may not seem to be that prohibitive, less than $400. Maybe I'll get caught. Maybe I won't get caught. Do you think the penalties should be greater? Well, it's not up to police to determine penalties, of course, or to determine laws. I will point out that a driving without do care attention ticket comes with six points against your license. That's a lot, and it probably will have consequences for your driver premiums or your insurance premiums. Could it be more that's up to legislators to decide? Obviously autonomous driving isn't evolving technology. We're going to have to keep an eye on this as a community

7:12and perhaps at some point the laws will change. But for now, let's be clear. You've got to be awake when you're driving. Okay, let me ask a question. Let me make it clear that this is not my point of view, but let me play devil's advocate here. If this technology is managing to keep these drivers on the highway and not get into a crash, because we haven't heard of a case in BC where this has ended up in a crash, maybe what they're doing is safe. What would you say to that? It's a bad idea to make legislation on counterfactuals. We prefer to be data driven. I think our legislators might be taking a cautious approach here. Does it need to evolve? That's up to them. But the law is clear, and police, we're here to enforce the law and educate people about the law. That's what we're going to do. One last thing, the first of these cases that we heard about in the newsroom was back in early July, I guess, in between Rebels token golden on the Transcandida Highway 1.

8:13And so a passenger saw somebody who was kind of lying back at the wheel appeared to be asleep, called the RCMP. And I know that the RCMP has reached, contacted that driver, but what we don't know yet is what happened. So these last two cases, drivers were ticketed. What about that case that pretty well was two months ago in Rebels Stoke? So that investigation is being handled by the Rebels Stoke RCMP. I know they've made progress, but I don't speak for them. And I understand that that investigation is still underway. One of the things I'll point out to people is that when you're ticketing on the Transcandida Highway, particularly through the Rockies, sometimes the registered owner doesn't live in the same jurisdiction that adds some challenges and practicalities, but I'll let them speak to what's actually going on in that file. And I'll also point out, Ian, that actually BC Highway Patrol did put out another news release in March of this year. So we've done at least three explaining this is an emerging phenomenon you might say, plus there's this other issue out of Rebels Stoke.

9:13So it is a going concern, though it should be pointed out, nowhere near the number of complaints we get for ordinary distracted driving, speeding or impaired driving.
