Police Scotland Fined for Data Breach in Rape Case

In 2020, Detective Constable Leanne Gilbert reported serious domestic abuse by the officer. Two years later, during a misconduct review, intimate images, medical records, and contacts from her phone ended up with the accused, his lawyer, and his union rep. The breach came to light in June 2022, when the union reached out to her. Much of the data had nothing to do with the probe, yet it was all handed over without safeguards. Police Scotland failed to report the incident to the data watchdog within the required 72 hours. Gilbert, now 34, and a mother to a young child, says the violation deepened her distress, leading to a PTSD diagnosis. She feels it wrecked her early motherhood, and left her numb at times.
