Mega Edition: Ghislaine Maxwell Appeals Her Conviction (9/4/26)

This July 27, 2023 filing was Ghislaine Maxwell’s reply brief to the Second Circuit as she appealed her conviction, and it centered heavily on her claim that Jeffrey Epstein’s 2007 non-prosecution agreement should have barred federal prosecutors in New York from charging her at all. Maxwell argued that she was an intended third-party beneficiary of the agreement because it promised protection to Epstein’s “potential co-conspirators,” and she contended that the protection was not limited to the Southern District of Florida. Her attorneys pointed to drafts of the agreement and the Justice Department’s later Office of Professional Responsibility report, arguing that language limiting co-conspirator immunity to South Florida had actually been removed before the final deal was signed. They also claimed the unusual structure of the NPA showed Epstein wanted broader protection for other people around him, including Maxwell, and argued that the trial judge should at least have held a hearing to determine the true scope of the agreement instead of rejecting Maxwell’s interpretation outright.
Maxwell also renewed her attack on the jury and her sentence. Her lawyers argued that Juror 50 had falsely answered questions during jury selection by failing to disclose that he had been sexually abused as a child, an experience they said closely mirrored the testimony of women who accused Maxwell and Epstein. The defense maintained that truthful disclosure would have provided grounds to remove him for cause and accused the district court of accepting explanations that were not credible while preventing a sufficiently broad inquiry into whether his personal experience influenced deliberations. Maxwell separately challenged the four-level leadership enhancement applied at sentencing, arguing that prosecutors had not shown she actually supervised another criminal participant such as Sarah Kellen. She ultimately asked the Second Circuit to reverse her convictions, dismiss some or all of the indictment, order a new trial, or at minimum send the case back for further hearings or resentencing.
