3:04And of course in eight o'clock we always do foodie Friday with Neil Subator, our fork reporter. He's heard to tomorrow afternoon two to five with the fork report his foodie show. What's going on today right now in the Lindsey Clancy trial. There is talk of a mistrial. And there was an accusation by I think the Jorp four person of the jury saying that one of the holdouts one. There was only one holdout is not following the rules, the instructions of the judge. And it's pretty close to a mistrial, which means everybody walks away and they start all over again. Now what else is going on is the House subcommittee has asked LA mayor Karen Bass to testify in Washington about alleged waste fraud mismanagement at LAHH. That's LA homeless. The homeless services authority, LASA. And this is following HUD, House of Units, the HUD's efforts to suspend LASA from applying for and receiving federal grants.

4:11Now that suspension has been blocked by a judge, but man it says a lot. Because the argument that the administration is making about LASA, it's not just the administration making those arguments. LASA has a horrible reputation. And it gets what maybe a billion dollars a year from the feds if I'm right on that. And the argument is, and this is what HUD is saying, housing and urban development that oversees homeless programs in various states and counties, or at least funds those. And that is that the whole thing is corrupt as well as mismanage or mismanage as well as corrupt corruption. I don't know about mismanagement very little doubt. The 10 member board is half the members are appointed by the mayor. The other half appointed by the LA County Board of Supervisor. And in his letter, the subcommittee chair has said, homelessness has gotten worse.

5:14As mayor's tenure goes on, particularly in Skid Row, she admits it. Because if you look at the hard numbers, yeah, homelessness that has gotten to a pretty high point right now. And even though the mayor has spent enormous amounts of money dealing with this. And as I've said many times before, homelessness is the projects have to be far very far wheeling. They have to be in front of the friend of the burner. And here is the problem. It is so rampant. It is such a big problem that to deal with it successfully is going to take virtually all the assets that a city or county has. Right now, the numbers we have are 48,000 people that are homeless. People that don't live in a place or live in their cars. That's a homeless. That's a homeless issue. August 26, for example, there is, that's the date in which LASA has to submit an application for $240 million in federal funding.

6:26And according to HUD, they're not eligible. They can't even submit the application because of the allegation of fraud and mismanagement. So LASA files a lawsuit challenging husband's action. And the here's the argument is that the attack on LASA is strictly political in nature. This is Donald Trump and the administration going after LASA. That's it. It's political. And the question is, well, how about the number of homeless people that have increased? Do you think anything is part of that? How about the allegations over the years that it is mismanaged? How about the allegations of fraud that have been so rampant? And here's the argument that I'm going to make. One or two people arguing fraud is one thing. It's dozens of organizations and people and government saying there's fraud mismanagement is very different.

7:27It's like someone alleged for a sexual misconduct. One woman comes forward and alleges misconduct against politician. Okay. I didn't do it. All right. There's an argument. What happens when 20 women come forward and make the same allegation? That seems to be the case here. It is a lot and a huge number of allegations going on. And here's the issue too. And I think a lot of it has to do with the way LASA it works. LASA does not control all the programs. LASA funds, guess funding, on behalf of 140 different homeless service organizations. How do you keep track of 140 different organizations? What kind of bureaucracy allows you to do that? And so what does LAS do? What does the county do? Set up its own homeless outreach where all the employees work for the county.

8:28Not for these nonprofits. They are now employees of the county, which of course is impossible. Absolutely impossible. So it's a no-win situation. And for bass, it's a seriously a no-win situation because she is in the state of the county. She is in a huge fight to get reelected. Normally, you would think it would be just she would skate into a second term. Not at all. Not at all. She is in a fight for a well, basically, her political life. All right. We'll see. I'm not a big fan of her either. I don't think she's done a very good job, but that's my opinion. Of course, that's my opinion. Or even better off, it's your opinion. I'll tell you what your opinion is. That's what this show is about. All right. What's going on with the Lindsey Clancy trial? Of course, the entire country is riveted to this.

9:28She is accused of killing her three children. I think that's pretty well established. She killed her three children. And then the fence says she was in a psychotic state such that she was insane effectively. And should be not guilty by reason of insanity. That's one of the charges that she can be convicted on. The other ones are first degree murder, second degree murder, and manslaughter. First degree murder, life in prison, second degree murder, I think it's 25 years. And manslaughter, it could get 15 years if I'm not mistaken. I don't really know what Massachusetts law is, no circumstances. So the jury is deadlocked. The jury's been deliberating 36 hours and cannot come to a decision. And it has to be unanimous. So now what happens? Well, the judge sent the jury back, which always happens. Jury Foreman says we are deadlocked, your honor. We can't make a decision.

10:28We just can't do it. Go back in and go through it again. It's important that you make a decision. Okay, second time out comes back and says we are deadlocked, your honor. We cannot make a decision. Now, Massachusetts law says that you can only go back twice. And after that, it is a mistrial deadlock, which means that you start all over again. If the prosecution wants to retry the case. However, under Massachusetts law, the trial that they can go back a third or more times, as many times with their consent, is one possibility. The other one, if the jury is asked for jury instructions, if they've asked the judge for instructions, that opens it up wide open again. And now deliberations, the third go is what the judge is able to force them to do. And that's exactly what the judge did. However, based on the jury question, it had to do with reasonable doubt.

11:32The defense has come in and said, your honor, based on what that instruction is, and what other jurors have said, this one hold out, one hold out, which makes it, of course, not unanimous, is not paying attention to the law. And here is where that line is so thin that it has to be navigated. And that is, if the juror is not paying attention to the law, for example, says, I don't care what the evidence says, I know he's not guilty. That's not paying attention to the law. If the juror says, yeah, I've seen what's being presented, I don't agree with you. So 11 to 1, I don't agree. It's that simple. And as a hold out, that becomes a, a directed where that becomes a mistrial and its legitimate. The juror is allowed to do that. There's nothing that stops the juror from disagreeing with the rest of the jury. So which one is it? Which one is it?

12:35Is it, I don't care? I'm not paying attention. Not guilty or guilty. Probably in this case, not guilty, I would guess. Or is the juror simply following his or her conviction? It's a his because the four person said it. He is not following the law. So there is a hearing coming up. The jury is back in court. Tensions were flaring. The defense attorney was going crazy. Ask the judge to declare a mistrial. The judge said, no. And now there's going to be hearing to find out if that lone juror and the judge is going to question every juror on the bench. And if that lone juror, in fact, did not follow what the evidence, for example, and simply made a decision based on his beliefs. What he thinks. Then it's over. Then the judge does declare a mistrial.

13:36She doesn't walk free. She's back in prison. Of course, in jail, awaiting trial. I mean, she's not walking. Well, she can't walk anyway. She's in a wheelchair. She's trying to kill herself. It's just a very weird case. It really is. And I was talking to Neil about this. I'm not in the jury room. But when you think about it, how does someone kill their three children, strangle a toddler, a six-year-old, a newborn 18 months old? How does someone do that without being crazy? The prosecution said she knew exactly what she was doing. She wanted to kill the kids. The defense is saying, look at all the drugs she was taking. Look at the depression she was under. She had asked for help. And then brought in a bag full of jars or full of bottles of medication, which looked like there were 30 of them in there that she had been taking.

14:36And the defense says she was looking for help. She asked for help. And then went into a psychotic episode enough so. So if the jury determines she is not guilty by reason of insanity because she was simply insane at the time. Then she goes to a medical facility and is dealt with for psychiatric care. And at that time a couple of things could happen. She's in for the rest of her life. She's in for a number of years or she's in for a fairly short period of time. And the psychiatrist say it was she was crazy at that time. She's not now. Now that almost never ever happens. So she is looking at medical care. Which if I am looking at either going to prison or being in a psychiatric institution, where do you think I'm going to go? Where do you think you're going to go? We'll see what happens with the jury today, with the judge says. All right. There is a poll that just came out.

15:41And man, I had no ideas of these numbers. So this is a survey conducted by the American University's sign institute of policy and politics was published on Tuesday. And 70% of the respondents age 18 to 34. So we're talking about young people said they weren't proud of where America is heading as a nation. The same number 71% said the same when asked about the state of the US today. They are not proud of the US. They are not proud of being Americans. Now, do I think America is going in the wrong direction? You bet I do. Do I think it's going to hell in a hand basket? Absolutely. Do I blame Trump for most of it? I do. Now there are other factors we went through COVID, which was no fun. We're going through this war in Iran. That's a Trump issue. It has just not been very much fun. But to say I'm not proud to be an American.

16:42Maybe because I'm an immigrant. And immigrants are more engaged in being Americans than people that are born here. It's because this is an adopted country. My parents adopted the United States. And they gave up their citizenship in Brazil. They were Brazilian citizens. And I wanted and became American today. You can have dual citizenship, by the way. I'm going for Polish citizenship. I want to be a member of the European Union. And I still keep my American citizenship. And I still have a Brazilian citizenship. So I have three passports. And so today is very different. But back to the survey. Now 59% versus 70% of these respondents, these young people said they do feel proud of the US and what it did in the past. Well, that part I'm part of that. And young people are navigating what is a rapidly changing America. That is one of the big issues.

17:43And there's going out about where we're going, surrounding the Trump administration, handling of the war in Iran, handling of the economy, handling of social programs that are disappearing like crazy, medical views under RFK Jr. There's a lot of issues going on. And right now the president's approval rating is sitting at 39% disapproval 57%. Those numbers are upside down for a president. So what does all of this means? Well, it means that we... Well, if you had talked, if you had done a survey in World War II, for example, you'd see 98% of Americans. I'm just throwing that figure out there, by the way, just an overwhelming majority saying we are going in the right direction. We are fighting a moral war. We are behind FDR. You always go behind the president. If stand behind the president whenever there's a war that just does something.

18:46Which is why leaders like to put people into wars when they're losing approval ratings. They like to engage in wars because the country stands behind their leader. And so right now we are up in the air as to where we're going, where we've been. I will tell you, in my lifetime, I have never seen it this bad in terms of people saying, I don't like America. I don't like where it is, where it's going. One of them is my wife, who wants out. And there are a lot of people I know that are getting out. Now, back to my Polish citizenship. I've applied for Polish citizenship so I can have a EU passport. I can go anywhere in Europe and I'm a citizen of Europe. So I don't have to worry. It was supposed to come in a year ago. The backlog is so great on those applications that it'll be another six months or a year.

19:49There are so many people that have made that application. And if you look at the number of people that are leaving this country, does that give you some indication of where Americans think, where we are going? And it doesn't bode well. It really doesn't. And the shame of it is, is we are a great country. Now, I'm not going to say we're the greatest country in the world. I'm not an exceptionalist. I believe for me, it's the greatest country to live in. Now, as far as medical care, you can go to any other country. As far as dealing with gun control, well, you don't need gun control in those other countries because you can't have guns. And so there are some issues of which I have a real problem with the United States. But bottom line, yeah, I'm proud to be an American. Matter of fact, it was when my parents became an American citizen. And I was there. It was, I think, at LA Convention Center at the time.

20:50And there were thousands of people in this big hall, in a federal judge, who can swear American citizens in because it has to be sworn in. Raise your hand. And I just get, I still get upset. Or I still feel it. And there were 3,000 people crying, literally crying. As they became American citizens, different worlds. No, they probably do that again, because all in all, how much they, how great they feel America is, is for an immigrant state still way up there. Okay. Now, a story that grabbed my attention and it has to do with travel and vacations. Going back in history, if you go to July of 1861, just as civil war started, there were hundreds, if not thousands of people coming out from Washington,

21:50you see, overlooking the first battle of the Civil War, first major battle. And they had picnic baskets and they looked at the south, totally decimating the northern forces. Oops. That's not a good thing. Well, what used to be a morbid spectacle now has emerged on something called dark tourism. Travelers who actively seek out war zones, radiation sites, volatile borderlands for their vacation, and there are 2 different kinds of dark tourism. One, I am in the middle of this is me. One simply visiting nations that are just dangerous. North Korea, Afghanistan, Haiti, US State Department says, do not go there. Just don't go there. And as opposed to a couple of countries where it's illegal to go there, for example, North Korea, but people still do. Or historical sites where horrific things have happened.

22:53For example, Jonestown, not dangerous, but man, you talk about dark tourism that we're going to Cambodia's killing fields or Auschwitz. Now, I have been to two out of those three places. For me, it's historical where horrible places, horrible things took place. But I don't joke about that because it reaches levels that are so deep. The killing fields of Cambodia, for example, Cambodia, where during Paul Potts, tenure as the leader, thousands, a million of people were killed. And the killing fields where so many took place, it was, you go out there and it's bucolic. Rolling little mounds of dirt, grass, there are trees, and underneath those, there are hundreds of thousands of people that were buried. Another one that is historical and very deep, you talk about dark tourism, is going to Auschwitz. If you're ever in Poland, I'm suggesting you go there to just feel how deeply dark human beings can be.

24:02Auschwitz, where over a billion and a half or two million people would put to their deaths, including my grandparents. And as I visited Auschwitz, I came out to the train tracks and was looking at the place where my grandparents got off of those cattle cars. After a three day journey, crammed into cattle cars, standing up, they couldn't move. And people were dying, so the person next to you was dead. No food, no water. And then they go off the cattle cars and were selected out. You, over to the left, you go to the gas chambers, of course people didn't know they were going. You to the right, you get to work. And my grandparents were in their 50s, so off they went. And the thing that hit me the hardest, and I didn't realize the extent and the depthness of the dark parts of humanity at Auschwitz,

25:08is that people who got there and were sent to the gas chambers, basically were there for half an hour. That was it. You think of Auschwitz where people work and then they go to the gas chamber and you think, it's a half hour journey getting off that train track and being marched about 900 yards into, quote, the showers. And man, if you go there, you talk about dark tourism. And particularly for me, more than many people, more than most, it just hits you so hard. You are silent. That is one kind of dark tourism. That's me. The other one is just going to those places that you're crazy to go to. For example, North Korea. And there was one guy that was interviewed. It's a CNN story and they did a bunch of interviews and said, the reason I like to go to dark Korea to go to North Korea is it's just safe.

26:09You betcha it's safe. No one is going to pick pocket you. No one is going to hold a gun to your head. No one is going to say, give me all your money. That is not going to happen. That's probably one of the safest places on earth to go to. It's North Korea. Also, I would not make jokes about Kim Jong-un either. That's not a good thing to do. So where do you go on vacation? Also, when you go to those places, there are no other tourists or very, very few tourists. When I visited the killing fields, there was almost nobody there. When you visit Venice, which I did last summer, it was Sardines. It was going over these little bridges and you were on the left. The people going the other way were on the right and you were crammed together. That's tourism. And we'll talk plenty more about tourism because I have a trip coming up. And just let you know by the way I'm thinking.

27:10And I am going to start a podcast, the travel podcast. Just to share my experiences, my crazy ass experiences that I have when I travel. All my disposable income goes to travel. That's where I spend my money. And the experiences are kind of fun. For example, the first time I went to France, I wanted to learn a French phrase, which I did to deal with waiters. And the phrase that I learned in French, mind you, was your mother was a Nazi collaborator during World War II, wasn't she? It didn't go over, it didn't go over well.
