Katie Taylor Wins Trademark Battle Against Katy Perry

Australia's High Court has cited with Sydney fashion designer Katie Taylor in her 16-year trademark battle against pop star Katie Perry. The court ruled that Perry's label, Katie Perry, and merchandise distributor Bravado were a citrus infringers of Taylor's Katie Perry trademark for clothing. Taylor, who was born Katie Perry, first registered her business name in April 2007 and the trademark in September 2008. The dispute kicked off when Perry's team opposed Taylor's trademark in May 2009 and sent cease and desist letters. Perry had lost her Katie Perry merchandise online around that time, including clothes sold in Australia. Despite internal emails where Perry's manager said they weren't trying to shut Taylor down, the singer wanted to stay out of it. Lower courts went back and forth. Taylor won initially in 2023, but lost on appeal in 2024 when judges ordered her trademark canceled.

The justices said Perry's fame in 2008 didn't extend to clothing and her team sales a branded apparel deliberately infringed. Taylor's mark, even though Perry's own trademark excluded clothes. Most merchandise sold during tours like her 2014 prismatic show was clothing items. Perry's spokesperson noted the singer never aimed to close Taylor's business and the case heads back to federal court for issues like Taylor's. Ten-year delay in suing.
