Raiford Palmer: Divorce Strategy and the "Meta Case"

In a high-conflict divorce, the facts and the law are only part of what a judge weighs. Raiford Palmer calls the rest of it the meta case: how you, your ex, and the lawyers behave toward each other over the life of a case, and how that shapes a judge's read of you when a decision is close. Managing it is its own strategy.

Raiford Palmer has been a lawyer since 1994 and a divorce attorney for more than twenty years. He is the managing shareholder of STG Divorce Law in Chicago, where his firm handles complex divorces, high-income and business-owner cases, and its share of high-conflict ones, using everything from collaborative practice and mediation to litigation. He is the author of I Just Want This Done, still a bestseller, and he is at work on a revised edition and a prequel. He and Lisa have recorded several conversations; this one is about strategy.

Palmer starts with your own side of the table. Tell your lawyer everything, including the parts that make you look bad, because the facts you hide are the ones the other side will surface against you later.He gives a measured take on alternative dispute resolution: a high-conflict ex does not automatically rule out mediation or collaborative divorce, but a manipulative party can also weaponize the process to delay and to wear the other person down, so the professionals have to read the situation and your own tolerance for it honestly. And he is direct that negotiating with someone who does not value fairness means setting logic aside and appealing instead to their ego and their public image.

He also walks through preserving evidence, a piece Lisa said she had never heard laid out this way: when you suspect hidden money, a court can authorize seizing and forensically copying a spouse's devices before anything is deleted, with the machines returned within days. He recommends talking to a financial forensic expert before you file rather than after, when a spouse who knows a case is coming may start making records disappear. And he argues for a sequence many people miss: finish the divorce first, and take a parenting-time fight back to court later, on its own, where it is cheaper, more focused, and paid out of your ex's own pocket.
