Mike Verabel is back on the sideline. We're going to dive into the return of the NFL here, giving you an idea of where we are headed. LSU has blinked in their big legal battle with the SEC.

3:10I will give you the absolute latest on that. SEC versus Big Ten Challenge. Why I think it is a no-brainer that makes a lot of sense. We have a brand new partnership with sport and state and the daily wire that I believe is going to be awesome for many years. Many of you, the Lindsey Clancy jurors have spoken. All of that and more headed your direction. But I want to begin with the NFL being back. It's been a long time since we last saw the Seahawks walk off the field as Super Bowl champions. We now have a Wednesday night game. And let me just say right off the top, thanks to everybody out there watching us on YouTube. I know many of you consume this many different ways. Some of you are just listening to the audio. Yesterday, we had roughly 500,000 views for this program alone on YouTube. We're now somewhere around, we're starting at zero. Somewhere around 5,000 subscribers.

Whatever your opinions might be. But we are certainly sharing with you a lot of different programs every single day. Now, tonight, I like the Seahawks to cover the three and a half. And I also think the under is the play. I think it's going to be low scoring. We will see whether Sam Darnal is going to have a one year flash in the pan revamp. I know he was decent with the Vikings before. But is this going to be enduring in terms of his pivot into the upper echelon of quarterbacks? On the flip side, last year, the Nungal Patriots had a very, very easy schedule. They were able to run roughshod over a lot of mediocre teams. Now, teams have gotten to watch all of the footage of Drake May. They know what to expect.

5:12I'll be it. They have now added AJ Brown as a big time playmaker to go alongside of Drake May. And we will see Mike Vrayble back on the sidelines after all the Diana Rousini drama that has been in the public for much of the past several months. So can the Patriots take the proverbial next step and become legitimate, bona fide, super bowl contenders again with Drake May in the role of the new Tom Brady and with Mike Vrayble in the role of the new Bill Bellicic. And is the Seahawks win that frankly kind of came a little bit out of nowhere last year with Sam Darnal. Is it a durable level of success? I'm excited to start to get the answer on Wednesday. Tomorrow, we've got another game. We'll talk about it with the Rams and the 49ers going head to head from Australia. But let me just tee off on this right now. Why in the world is the Republican party having the first ever midterm convention that is designed to draw attention to the successes of President Donald Trump and going head to head with the NFL on Wednesday night and head to head with the NFL on Thursday night.

6:24Now some of you out there can say, oh Clay, I don't care. I don't care about the fact that sports is going head to head. I care more about the Republic. I care more. I get it. Most people are not you. There are going to be 30 million plus people that are watching the NFL on Wednesday and Thursday night. Beginning tonight, it is going to be virtually impossible to create any kind of substantial story at all that cuts through the noise and gets the national attention. I really do believe this Netflix. I bet you is not debuting any new show that's designed to appeal to men over the next two days. I bet you Amazon is not doing it. They're not doing it on any of the other networks because men overwhelmingly are going to be watching these games. And so if your goal is to capture the attention of the nation to get non-traditional voters to pay attention, the decision to go head to head with the NFL to me makes a zero sense.

7:25It is indefensible from a capture the narrative arc perspective next week. Why couldn't you have done it on Tuesday and Wednesday? What is the reason why you needed to go head to head on Wednesday and Thursday? Now just so you know, I will be down in Dallas having said all of this tomorrow. I will be with the daily wire. They've got a huge big sports bar that they have taken over. I'm doing a couple of different shows with them. I'm looking forward to it. But I'm also questioning why is it that we are in a position where President Trump, who is a huge sports fan, is going to be going head to head with the NFL to me. It absolutely makes zero sense. LSU and the SEC have been running at each other full speed over the past couple of weeks on the legal issue of weather players are eligible to come back from NFL training camps and play in college. Lane Kiffin and LSU and Louisiana court judge have said yes. The SEC has said no, no, no, no, no, we're not going to permit this. This violates our rules. There was a Louisiana State court hearing last week. Today, there was scheduled to be a federal district court hearing.

9:36But last night, as I was coming back from Washington, DC, where I was for a 25th anniversary tunnel detours event in Washington, DC. Frank Siller and his team did a great job putting that on last night. I get off the plane. I looked down at my phone and LSU has made the decision not to roster the two different NFL players. This is the right call period. Okay, the fact that it took this long to get here is I believe an indictment overall of the LSU decision making process. But this is the right call. It basically gave LSU an offer amp. If you feel like the players are not being treated fairly, if they're going to sue, they can be paid to work as graduate assistants to be compensated in some way. The SEC yesterday, as we reported at Sport and State, was prepared to have a meeting tomorrow to discuss removing LSU from the SEC.

10:39That is significant consequences. As I told you, the risk reward for LSU was not in their favor. It didn't make any sense at all to me to risk a team that is good enough to contend for the playoffs and could certainly contend for a national title as well. Over two players that were unlikely to change the outcome of any game all season long. We saw how good LSU looked against Clemson and to me, LSU, even though it took several weeks, made the rational decision back away from the abyss and has ended up in the right place. So credit to LSU, the SEC was going to take this seriously. There were 15 schools that could have potentially been willing to remove LSU from the SEC. And by the way, we had a Sport and State graphic on this. I believe in order, we had some fun with it. If LSU had decided to leave the SEC or been kicked out, my top five replacements in order, North Carolina, Virginia.

11:43Virginia Tech, Miami and Florida State. I might have flipped Miami and Florida State there, but that's my top five for who I would have replaced theoretically. LSU would either go independent at that point in time or they would join the big 12. I think what you saw was when the SEC put out their court filing, it was a little bit like when dad goes and gets the belt. There's lots of chirping from the kids about what they're going to do or whether they're going to listen and then finally dad just says, okay, I'm going to go get my belt. Or back in the day, I don't even know if they still have corporate corporate punishment or not. Do you remember when you were in elementary school when the teacher brought out the paddle? You would all be talking, everybody's talking really loud. And then the teacher just kind of slowly pulls open the drawer on her desk most of the time it was girls, most of the time it was women. Slowly pulls the paddle out and just puts it on the desk so everybody can see it and slowly the hush starts to descend.

12:49And then if you really got into it as a class, sometimes the teacher would stand up, grab the paddle and hit her own hand. That's kind of what the SEC did to LSU. They pulled the paddle out, they put it on the desk, they looked right at Lane Kiffin, they looked right at the president of the university, they looked right at the athletic director and Greg Sankey said, wouldn't it be a shame if I used this paddle? Do I really need to pick this up? Are you sure that you are committed to the choices that you are making so far? And LSU got awful quiet in a hurry. It's the right decision, it's a deescalating situation. You know what's not deescalated? The fact that Michigan cheated and beat Western Michigan on a play that should not have been allowed to occur.

13:49I know people are saying, oh Clay, why are you still talking about that? Well, I'm still fired up about it. Okay, that's why I'm still talking about it. Last night I also saw this report. This is from Ralph Russo, a memo obtained by the athletic from the NCAA Secretary Rules Editor, expected to go out to conferences and officials, clarifies the protocol to be used when a replay review requires time to be restored in a game. They said, you use the televised version of the game. This is what Mike Pereira told us on Joel Clatz podcast. This is what everyone has already been saying. Hey, the reality here is simple. You use the video feed that 10 million people saw, not the video feed that three people in an instant replay truck allegedly saw. This is not a crazy take. It actually makes complete and total sense.

14:51And the Mac now is saying the big 10 blew it and they violated instant replay protocols and Western Michigan actually won the game. This is now the Mac. Here's what they said yesterday. After further study and investigation, it is now evident that replay protocol was not properly followed in determining whether time remained on the game clock at the conclusion of the Western Michigan versus Michigan football game. The established replay protocol requires the game clock displayed on the program feed be used in determining whether time remain. Instead, the big 10 conference replay crew relied upon the clock feed embedded within its replay system. As a result, one second was placed back on the game clock and an additional play was awarded. This was not a judgment. It was an error and had the appropriate protocols be used.

15:53Western Michigan would have won 12 to seven. Okay, that's what they write. Here's the final paragraph. As a result, the mid American conference has submitted formal appeals to the NCAA FPS oversight committee and the college football playoff. The Mac is requesting that those bodies recognize Western Michigan as the actual winner of the game for purposes of their respective rankings, evaluations and selection deliberations and take such other corrective action as may be within their authority. Now, yesterday on the program, I told you, I thought there might be some sort of secret negotiation relationship from the Macs and getting told, hey, we'll pay you a little bit more money in future years. Hey, we'll play more games because your budget Mac schools is very much determinant on being able to play against big 10 schools. Get the so called pay for play situations.

16:54I still think that's likely where this ends up, but the Mac position has altered significantly as more people have come over to the side of sanity. That is the clay Travis side. That is the side that said, this is an egregious error on the part of the big 10. There is no way that this should have ever been allowed to have occurred to Michigan's credit. They still had to complete the Hail Mary, but the reality is the Hail Mary should have never been possible to even be completed because we never should have been in a position where Michigan got an extra second. So that is continuing. All right, you want a, and I think do we have the game interpretation? I don't know if this went up or not because I was reading. I think we have a photo in the graphics. There it is of the statement that was put out about how this interpretation occurred and what should happen going forward. Okay, good news.

Week 1's college football slate this year. Stunk. It was awful. It was putrid. I love college football by 115 on the East Coast on Saturday. An hour and 15 minutes after all these games kicked off, there were no good games. And while I enjoyed Louisville versus Ole Miss, there shouldn't have only been one top 25 game played. We shouldn't have to sit around and enjoy North Carolina and TCU, 15 to 10 outcome. I appreciate 17, 16 Auburn over Baylor. I appreciate the fact that there were good games. Colorado came back and stole one from Georgia Tech. But they were few and far between actual major conference FBS matchups, which is why we need a real legitimate bonafide SEC versus Big 10 challenge.

20:08What's the number one argument that is out there now in college football? My conference is better than your conference. We hear it all the time. The Big 10 is better top to bottom. SEC fans love to say the SEC is better top to bottom. Why don't we solve it once and for all? Every single year, this could be like the rider cup of college football on the opening Labor Day weekend of the year. Or the week before, whenever you want to do it, before the NFL takes over the sporting calendar, you can play 12 games, 12 games between the SEC and the Big 10. Six on each campus, six on SEC campuses, six on Big 10 campuses. And you reward the conference that wins with some sort of trophy, with some sort of commendation, and it's a lot like the rider cup.

21:09You could play, think about it, you could play two games on Thursday, two games on Friday, three games on Saturday, three games on Sunday, and two games on Monday, 12 games Thursday, Friday, Saturday, Sunday, Monday, five days to get the 12 games done. Tell me this wouldn't be amazing. Okay, now, some of you are saying, well, there's 16 SEC teams play, why only 12 in the head to head challenge, because right now you have nine conference games. And what Greg Sanky, the commissioner of the SEC is pushing for is one more FBS game. And then you could play basically two cream puffs, so 10 power conference games, nine in conference, one outside right now, South Carolina, place Clemson, Louisville plays Kentucky, Georgia plays Georgia Tech. And Florida plays Florida State. There are four SEC schools that play a power conference game against an ACC school, they're in state rivals.

22:13Those are great games. And so I understand why South Carolina Clemson, Georgia, Georgia Tech, Florida, Florida State, Louisville, Kentucky, why those teams would be pulled out, but you could still play 12. Six on each campus, alternate it, seed them one to 12 based on the preseason matchups. And that way you are figuring out an even matchup, right? So I laid it out, I looked at the preseason rankings that are out there. And I said, okay, what would be a fair way to actually handle this? And to me, it's kind of a no brainer. Here's what it would look like for instance, this weekend, the way it would shake out, it would be, or this past weekend, Texas against Ohio State. Thankfully, we've got that. I'm going to be talking about it. My gambling picks, by the way, were a disaster. I went to eight and one, but I'll have the gambling picks up a little bit after I finished the show today.

23:15Ole Miss Oregon, Texas A&M Indiana, LSU USC, Alabama versus Michigan, Oklahoma versus Penn State, Tennessee versus Washington, Missouri versus Iowa, Auburn versus Illinois, Vanderbilt versus Minnesota, Mississippi State versus Nebraska, and Arkansas versus Wisconsin. Tell me this would not be absolutely a phenomenal setup. To me, it's a no brainer. It should happen beyond a shadow of a doubt. Our town is small taters by most standards, right? But to the people who grew up here, it's everything. What happens when a quiet Tennessee town becomes the front line in a battle over the future of America? 28:29Big time trades that shake up the NFL. AJ Brown is loose. And of course, those Seahawks trying to run it back and win another Lombardi trope. The Seahawks win Super Bowl 60. They are bringing Lombardi back to the Northwest. If it's happening on a football field, NFL Daily will cover it. ESPN now has a 30-day window to decide how much they will bid for a 24-playoff team scenario. Right now, the ESPN in the 12-team playoff has 11 games inside of that. And they sublicin' some of those games to a partner. I think it's Paramount right now. Am I correct about that? I am in the college football playoff.

29:29There has to be a determination now made by Disney slash ESPN. How much do they want the exclusivity of a 2014 playoff? And what does it work to them? If there isn't a bid that the college football playoff takes, then in theory, a 2014 playoff would go out into the larger media ecosystem. And you could see Amazon, you could see Netflix, you could see Fox, you could see CBS, you could see NBC. Any number of other networks might decide to step up to the plate and bid on some of those 23 playoff games. Is it possible that the streamers could dive in and decide to get involved? It is Paramount by the way, they own TNT, right? That's Warner Brothers, I guess. Paramount's trying to buy Warner Brothers.

30:30TNT is who gets the sublicensed games that otherwise ESPN is paid for. This is a story worth paying attention to. First of all, because it would lead to an expanded playoff, second, because at least in this scenario, it could create an opportunity for somebody else to sweep in. Maybe one of the streamers wants to have the first two rounds basically of the playoff going forward. This would create a lot more on campus games. I understand it's controversial. Not everybody agrees with me. I would support a 2014 playoff. It's basically the top 23 best teams and then a highly ranked, my understanding is non-power conference team would be guaranteed. Personally, I think you should just take the top 24 in order. That should be what the playoff ranking is. The top 24 teams get in, one to 24.

31:30Top eight in this scenario, by the way, would get buys. So you would have 16 teams playing in the first round. Top eight teams get buys, then they play in the second round. That's kind of the way the bracket would work if you're out there wondering. Okay, a couple of other things that are out there. This video is going viral. Florida Gators have a brand new head coach. His name is John Somerall. And this is what John Somerall sounded like as he got ready to lead the Florida Gators out for their first game against FA. You listen. Don't forget playoff. Tonight are we good? Yes sir. I don't think we're going to play him. We're going to do this. No. Everything you got. Oh, freaking nice. Don't let him off the hook. Don't let him off the hook. Watch the game. Take the rest of the team forward. And see if they can swim. They can't drill. Chuck their thumbs.

32:31Get good. Yes sir. Playoff. Playoff. Playoff. Everything you got. Family off. That is awesome. Okay. All of that college football, all of that NFL fun for quality with everything associated with it. I'm going to tee off now. I continue to see a ton of crazy people out there who are defending Lindsey Clancy. And this got even more intense yesterday after some of the Lindsey Clancy jurors decided to speak. Here is a clip of them explaining why the one guy who would not vote to convict was just unacceptable to them. Let me reiterate again, the guy who refused to vote to convict for six days is a hero. He stood on the side of truth. He refused to be bullied by all of the other jurors.

33:31I watched some of these juror interviews and many of them out there basically said that they were persuaded by the more dominant jurors on this on this jury pool that they should vote not guilty by reason of insanity for Lindsey Clancy. Let me be clear on this. And I went on Fox News a little bit earlier and some people were angry at me, including my good friend, Seuss, who sent a message saying immediately after I got off of the Fox News broadcast, you are a disgusting man. When was your last period? When did you deliver a baby, a lawyer? Well, think so. A quick bait attention, seeker and butt ugly all caps. Now, you know, I appreciate that, Seuss is a big fan. I don't understand how making the argument that if you are a mom or dad and you kill your

34:34kids, which I think is the single worst thing a parent could do, there should be severe consequences for that. And much of the discussion surrounding Lindsey Clancy has been about her mental capacity as it pertains to this particular incident. To me, the story here should be why don't we expand strict liability, criminal offenses to anyone out there who kills their kids and let me explain this a bit more. But the overall take I would have is this. And this is me from a lawyer perspective. And you can share this with the women in your life. If you're a man, you're probably in disbelief that there are so many women out there who basically treated this as the OJ Simpson trial. This was Lindsey Clancy, the OJ Simpson trial for white women. Except I'll say this, OJ had a much better argument that someone else did the murder

35:41than Lindsey Clancy did because OJ actually disputed the act itself. Let me explain. In criminal law, there are two parts to every murder. And I've done criminal law. I've defended murders. I've defended people accused of sexual assault. I've defended people accused of drug dealing when I was a young guy. Every crime requires two things. The act itself and that's the act of Sreya and then the minzreya, that is the intent. Okay, a crime consists of two parts. Everyone acknowledges that Lindsey Clancy committed the murder. She did the act. Now some people out there saying, Clay, you don't know, it was her husband who did it. That is not true. She was trying to defend herself. She could attack the act itself and say someone else did it, right?

36:44For those of you who remember the movie, The Fugitive Back in the Day, the argument that Richard Kimball, the doctor there put forward, was that a one-arm man had actually killed his wife. And the Tommy Lee Jones character is the FBI agent and Kimball is trying to find the actual killer. OJ said after he was acquitted, I'm going to spend the rest of my life trying to find out who the actual killer was. OJ's defense was, I didn't do it. It was somebody else. The LAPD is racist. They set me up. He never really explained who else did it, but he attacked it the act itself, right? I didn't do it. Lindsey Clancy's defense admits that she committed the murder. For those of you out there trying to argue with someone else, they don't even provide any suggestion of that being the case. It would be a complete disbarment level offense.

37:45If Lindsey Clancy's attorneys had evidence someone else committed this murder and they never introduced it at trial, it would also mean that they would have provided ineffective counsel at trial, which would mean that the underlying case itself was illegitimate. But there is no suggestion that anybody else did it from the defense at all, okay? There is no, it was somebody else. They don't go OJ. They go straight to the men's rea. She didn't have the requisite intent because she was temporarily insane. Therefore, she cannot be guilty of first degree murder. Let's eliminate the men's rea requirement of child murder prosecutions. Step back. Some crimes only require that you commit one of the offenses, that is the act itself, and I'll give you an example. If you are 20 years old and you sleep with a 17 year old, let's say you're 21 and you

38:53are out at a college bar and you're drinking beer and you have to show an ID to get into the college bar and you meet a girl there and she says she's 21, she's drinking a beer, she had an ID to get in. If it later comes out that she's actually 17, you aren't able to defend yourself by saying she lied about her age. Sleeping with her is a strict liability offense and you could be prosecuted for it. If you did it, it doesn't matter what you intended. You intended to sleep with somebody who's also your age. In some states, you could be prosecuted for sleeping with a 17 year old, even though she lied about her age, she got into the bar, strict liability offense. The reason why we have strict liability offenses in the cases of minors is because we believe that minors particularly should be protected.

39:55Why in the world should this same logic not apply to young children, Lindsey Clancy choked her five year old, three year old, and eight month old with an exercise band? If you can be prosecuted and have no defense at all, if you sleep with a 17 year old and you're 21 because we're trying to protect minors, how in the world can you murder three of your kids and not have a strict liability offense when you admit that you did it? You're defending yourself by not guilty by reason of insanity, basically. And if the jury agrees with you, you could be out of your insane mental hospital and found no longer to be insane. Within 40 days, you're a free human. This is crazy. It should be a strict liability offense. Do we have the jury? Is it playing at all?
