Body Cam Footage Challenges DHS Shooting Account

Newly released body camera videos are challenging the Department of Homeland Security's account of a fatal shooting in Texas last year. On March 15, 2025, a federal immigration agent killed 23-year-old U.S. citizen Rubin Ray Martinez during a traffic stop. On South Padre Island, officials initially said Martinez intentionally rammed an agent with his car, but the footage shows his vehicle moving very slowly. The incident happened late at night near a car crash, where local police and three homeland security agents were directing traffic. Martinez was driving with a friend after drinking and smoking marijuana on a beach trip. His blood alcohol level tested at 0.12 percent, above Texas' legal limit of 0.08 percent. A grand jury recently declined to charge the agent, Jack Stevens. Witnesses in the passenger in the car describe Martinez as panicking over a possible arrest for driving while intoxicated. He slowed nearly to a stop before inching forward as agents approached.

1:03The shooting marked the first of at least six fatal incidents by federal agents amid a nationwide immigration crackdown. The videos do not clearly show the car striking anyone, contradicting Stevens' statement that he feared a mass casualty attack like a recent vehicle. Ramming. The agent who was supposedly hit walked away without visible injury and autopsy confirmed three bullets hit Martinez in the torso. Martinez' family lawyers argue the evidence shows no reason for the shooting and are pushing for more records.
