And all the rest. And it's all because of a slight of hand trick that we've caught here on legal a f about a term conflating one imbalance with another. It's all a failure. It's all a fraud. It's and it's going to be heard in the in a court you probably never knew about six months ago. But now is all the rage the United States Court of International Trade on Michael Popak back from holiday back behind the microphone. And so happy to be with you here on legal a f all right. Here's what happens side note court of international trade judge eaten just decided in the last 24 hours that the all refunds have to start now. He's he now if you are in process and you're applying now. He's ordered that the Trump administration deduct the amount of the tariff under the
international economic emergency powers act and return it to the American importer. Separately you have this lawsuit. This is about after Donald Trump in a petulant fashion pissed off that he lost to the United States Supreme Court on the tariff decision. And he wanted to reimpose tariffs of a different kind. Also illegal under section 122. Now in order to do that though, there's a precondition or a prerequisite. There has to be a finding that there is a balance of payments issue. And therefore you can impose tariffs to balance it not impose tariffs on 200 countries because of a perceived artificial balance of trade problem. Balance of payments really has to do with the value of currency right the exchange rate of currency once we came off the gold standard and we just became a paper dollar backed by the treasury
and the full faith and credit of the US government and other states and countries did the same thing. Then there's there's sometimes fluctuation in because of the value of the dollar versus other currencies in the balance of payments. So what was paid at one time by a country in their denomination of currency. There might be a slight fluctuation in the exchange rate and therefore some leakage. That's a balance of payment problem. We don't have a balance of payment problem in this country. We've never had a balance of payment problem because of the strength of the US dollar around the world. I mean, we're talking about rounding errors. We're talking about things so infinitesimal that they're not even counted by other governments. And yet Donald Trump says we've got we've got a hundred billion dollar or whatever it is a temporary balance of payments issue. Oh my god, hit the emergency button. Let's do tariffs again. No balance of trade. See, the balance is the only word that's in common is when there is a deficit or a surplus. If you as
a country are exporting, right? People are buying more of your goods than they're buying of yours then there's a trade deficit in favor of the other countries. If they're buying more American goods than they're selling in our country, then it's a trade surplus in our to our advantage. But even that is artificially created by Donald Trump because you have to ignore the service economy. See, goods are goods. Goods are durable things you can touch and feel, right? Including agriculture. Services are what America is very good at, consulting services and computer services and legal services and accounting services. And they have a dollar value too and they're very high. When you add the balance of services, along with the balance of goods, there's actually very little trade deficit. Set that aside for a moment. They say on page two that the same day the Supreme Court invalidated Trump's IEPA, the International Economic Emergency Powers Act tariffs. The president began side stepping its ruling by imposing a 10% tariff on most products worldwide pursuant to section 122 of the trade act of 1974, which was at one time exploited by Richard Nixon sort of along the same
term. See, every time we get a criminal presidency, we get the same sort of exploitation of our tariff policy. Section 122 exists to permit a limited tariff authority to address fundamental international payment problems that require special import measures to deal with large and serious balance of payments deficits. So you have to have a balance of payments benefit deficit. But they say on page seven that the justification is fatally flawed. The president is contorting the term balance of payments, redefining it contrary to its meaning and cherry picking only the negative components while ignoring entirely the huge net positive financial inflow components that make up balance of payments. Second, a balance of payment crisis is a currency crisis that was of great concern when Congress enacted section 122 in 1974, but no longer exists because we ended fixed rate currency gold standard in 1976. We don't have a balance of payments problem and we don't have the
Nixon shock problem from the 1970s, which that section was meant to apply to. So what they say in their filing, which is now before the court of international trade in New York, on page six on paragraph 62, the balance of payments is made up of a nation's current account, which is the receipt on payments on its goods and services and income and currency transfers its capital account and its financial account, which is a record of transactions between US residents and foreign residents. And only then do you have an imbalance, but we don't have an imbalance. A trade deficit is not a balance of payment deficit. Therefore, you can't use the section 122 method to to tariff i.e. tax your way out of your economic crisis and your petulence. Here's what it says on paragraph 82 absent from President Trump's proclamation was the fact that in 2024, the most recent year,
the balance of payment position was a mere 0.2 percent of the gross domestic product of the United States, which is its total value of its output goods and services. So he also says the World Bank treats any difference of that level as a rounding error and a statistical anomaly. So ignore it. Not use it to collect. So they're asking the court to declare that the section 122 tariffs are ultravaries, which are violentive of the statute. There's no statutory authority. It violates the separation of powers once again under the Constitution article one section eight, which gives the power to tariff and tax to who to Congress.
