The main issue was that the original judges didn't factor in their youth and immaturity when handing down these IPP and DPP terms back in the day. These schemes meant for folks deemed dangerous to the public, locked people up past their minimum tariffs until parole boards said otherwise. They got scrapped in 2012, but thousands are still stuck serving time way beyond what's fair. Guys like 20-year-old Stuart O'Neill for a 2009 rape case in Manchester, 19-year-old Jay Davis for a firearm charge in two, 2006, and Benjamin Hebert for sexual assaults as a teen. These men spend years extra in lock-up. O'Neill passes three-and-a-half-year tariff, Davis beyond nine months, Hebert over two years. The criminal cases review commission flagged their cases, arguing age-mattered big time. Now O'Neill gets eight years custody, plus eight on license, Davis just 18 months total, while Hebert's awaits a fresh report.
