About this episode
Nintendo is straight-up suing the Trump administration for full refunds plus interest on tariffs the Supreme Court already ruled illegal. The company says the duties delayed Switch 2 pre-orders, jacked up accessory prices, and cost them a fortune — and now they want every penny back. We break down the lawsuit, how these tariffs screwed over one of the biggest gaming companies on earth, and why this is just one of over 1,000 similar cases hitting the government right now. This whole tariff mess is getting messier by the day.Watch the podcast episodes on YouTube and all major podcast hosts including Spotify.CLOWNFISH TV is an independent, opinionated news and commentary podcast that covers Entertainment and Tech from a consumer’s point of view. Nintendo is suing the Trump administration over illegal tariffs that delayed switch to pre-orders. According to Mashable, so the US government is being sued by more than a thousand companies seeking a refund on Trump's tariffs. I know Hasbro is suing them as well. So let's take a look at this. Remember when the switch to pre-orders were delayed last year due to the tariffs. Nintendo sure does, as first noticed by gaming news outlet. Aftermath, Nintendo filed a lawsuit today against the Trump administration in the US court
of international trade. Now that the Supreme Court has struck down Trump's tariffs, Nintendo wants a refund with interest. That's not an expression either. The suit asks the court to order the prompt refund of the unlawful tariff fees with interest and attorney fees. Nintendo's lawsuit is a direct response to the Supreme Court's decision last month, which struck down Trump's signature tariffs evoked under the International Emergency Economic Powers Act of 1977. Nintendo is one of more than one thousand companies including FedEx and Costco now suing over the tariffs. I remember people were really panicked about the tariffs, they're like, Trump's tariffs are going to like destroy everything. It lasted for a couple of months. I think a lot of people really panicked before they knew what was going on, but it was bad. I know a lot of small business owners were like, they're going to double the cost of goods. I know anybody that dealt with China importing from China was looking at like twice the amount of money, some board game manufacturers went out of business, they preemptively just closed down because they're like, we can't eat that cost, but then it just kind of came
and went. Gamers will remember that Trump's tariffs hit just as Nintendo was writing the launch of the swish to last year due to the uncertainty around the tariffs at the time, Nintendo delayed pre-orders for the switch to. At the time, Nintendo Microsoft and other companies forced to raise prices or delay shipments often blamed the evolving market conditions rather than calling out Trump and the tariffs by name. You know what happens when you call Trump out by name, but we know the spring, but now the Supreme Court has ruled against Trump. The companies are done being co-ined. Nintendo has been substantially harmed by the unlawful execution and imposition of the unauthorized executive orders and corresponding payments of the IEPA duties Nintendo is asking the court order to the prompt refund with interest of any duties paid by Nintendo, regardless of liquidation status and provide any and all remedies that the court deems appropriate.
