Jury Deadlocks in Winton's Manslaughter Trial

0:00In Birmingham, it's March 14th, and here's what is going on. A jury couldn't reach a verdict on Friday in the reckless manslaughter trial of John David Winton, who's charged in the death of 10-year-old Ember, Poe in Montevallo last November. Poe was riding her scooter on Spring Creek Road when Winton struck Strucker, and she passed away eight days later. He also faces charges for unlawful possession of a controlled substance and drug paraphernalia. The main debate centered on whether Winton had drugs in his system during the crash. He first told police he only had Advil, and that some items in his truck weren't his. But later admitted to using methamphetamine five days before. Defense lawyers pointed out he passed a field sobriety test, and didn't spot Poe until his headlights lit her up right in front. Prosecutor said she was visible from farther away, giving him time to stop. Deliberation started just after 11 a.m. Friday and we'll pick back up on Monday as everyone waits for a decision.
