0:00The Weston Cape High Court has declared a section of South Africa's valued added tax unconstitutional ruling that it unlawfully gives the finance minister the power to change that without Parliament's approval. The court found that the provision grants excessive authority to the executive but it has suspended its order for two years to allow lawmakers to correct the defect. Mangalisukumalo has more. The ruling centers on a section of the value added tax act 89 of 1991, which allowed finance minister Enok Kodongwanda to announce the change to the value rate during the national budget. The case was brought by the DEA, which argued that the provision improperly delegates Parliament's constitutional authority to impose or adjust national taxes to the executive.

1:10The ruling comes after Kodongwanda last year announced plans to increase that from 15% to 15.5% in 2025 and so 16% in 2026.
